3. Basements used exclusively for the service of the building <br /> may have access to only one exit. For the purposes of this <br /> exception, storage rooms, laundry rooms, maintenance offices and <br /> similar uses shall not be considered as providing service to the <br /> building. <br /> V. Section 3002.4 of the 2006 edition of the IBC is amended as follows: <br /> Where elevators are provided in buildings, at least one elevator shall be <br /> provided for fire department emergency access to all floors. The elevator <br /> car shall be of such a size and arrangement to accommodate a 24-inch by <br /> 84-inch(610 mm by 1930 mm) ambulance stretcher in the horizontal, <br /> open position and shall be identified by the international symbol for <br /> emergency medical services (star of life). The symbol shall not be less <br /> than 3 inches (76 mm) high and shall be placed inside on both sides of the <br /> hoistway door frame. <br /> Exception: If all stories within the building have direct, accessible <br /> egress to grade. <br /> W. The 2006 Editions of the IBC and IRC are amended by addition of the <br /> following section: <br /> Authority to Abate <br /> 1. Any violation of the IBC or IRC determined to exist after inspection by the <br /> Building Code official is hereby declared to be a nuisance. <br /> 2. Where a nuisance exists, the City Attorney on behalf of the City is authorized <br /> to institute injunction, mandamus, or other appropriate action or proceeding to <br /> prevent the violation of the IBC or IRC. <br /> 3. Notwithstanding paragraph (2), the City Attorney is authorized to apply to any <br /> court of competent jurisdiction for and such court, upon hearing and for cause <br /> shown, may grant a temporary or permanent injunction restraining any person, <br /> firm and/or corporation from violating any provision of this Code and compelling <br /> compliance herewith. The cost of such action shall be taxed against the violator. <br /> 4. A conviction of any person, firm or corporation for violating this Code shall not <br /> impede the authority granted in this section to the City Attorney or City. <br /> Section 5: Repealer. Ordinance No. 2771-04 (Chapter 16.01 EMC), Section 1 <br /> Ordinance No. 2403-99 (Chapter 16.01.110 EMC) and Ordinance No. 773-81, Sections 1 <br /> through 4 (EMC 16.58), Ordinance No. are hereby repealed. <br /> Section 6; Severability. The City Everett hereby declares that should any section, <br /> paragraph, sentence or word of this ordinance, the International Building Code and the <br /> International Residential Code hereby adopted be declared for any reason to be invalid, it <br /> is the intent of the City of Everett that it would have passed all portions of this ordinance <br /> and the Code independent of the elimination of any such portion as may be declared <br /> invalid. <br /> Section 7: Savings. This ordinance shall not be construed nor held to repeal Ordinance <br /> No.'s 2403-99, 773-81, 2771-04, 2068-95, 1732-90, 1731-90,1613-89 or 1610-89 as to <br /> any offense committed against such former ordinance or as to any act done, any penalty, <br /> forfeiture or punishment so incurred or any right accrued or claim arising under the <br /> -6- <br />
