04/1. 41,2 11.341'1 <br /> Ordinance No. 3006-07 <br /> AN ORDINANCE providing for the adoption of the 2006 State Energy <br /> Code and the State Ventilation and Indoor Air Quality Code, and <br /> repealing Ordinance No. 2770-04 (Everett Municipal Code Chapter <br /> 16.10). <br /> WHEREAS, the City Council finds that this ordinance serves to protect <br /> the public health, safety and welfare; <br /> WHEREAS, the City Council finds that the absence of the regulations <br /> adopted by this ordinance would create public harm and a public nuisance; <br /> WHEREAS, the City Council finds that it is appropriate for the Board of <br /> Review to have discretionary power to approve plans and a time frame for <br /> bringing existing buildings into compliance with the ordinance so long as the <br /> requirements are not waived and the time frame does not exceed one year; <br /> WHEREAS, the City Council is aware that the 2006 State Energy Code <br /> and the State Ventilation and Air Quality Code takes effect in all counties and all <br /> cities on July 1, 2007; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Short title and adoption. <br /> A. This ordinance shall be known as the "Everett Energy and Ventilation <br /> and Indoor Air Quality Code." <br /> B. The 2006 State Energy Code, Chapter 51-11 Washington <br /> Administrative Code, and the 2006 State Ventilation and Indoor Air <br /> Quality Code, Chapter 51-13 Washington Administrative Code, save and <br /> except such portions as are hereinafter deleted, modified or amended, are <br /> hereby adopted by reference and incorporated herein as fully as if set out <br /> at length herein, collectively referred to as the "Code" unless specifically <br /> provided otherwise. <br /> Section 2: Authority to Abate: <br /> The 2006 State Energy Code and the 2006 State Ventilation and Indoor <br /> Air Quality Code are hereby amended by the addition of the following: <br /> Authority to Abate <br /> A. Any violation of the code determined to exist after inspection by the <br /> Building Code official is hereby declared to be a nuisance. <br /> B. Where a nuisance exists, the City Attorney on behalf of the City is <br /> authorized to institute an injunction, mandamus, or other appropriate <br /> action or proceeding to prevent the violation of this code. <br /> - i- <br />
