Notwithstanding any language in this Code, in the event a time period is established in(1) a violation citation issued by a Code Compliance Officer or the Building Official, or his or her designee, or(2) an order issued by the Violations Hearing Examiner, said time period shall supersede the time period provided by this Code. Section 6: Severability. The City of Everett hereby declares that should any section, paragraph, sentence or word of this ordinance, the 2006 State Energy Code or the 2006 State Ventilation and Indoor Air Quality Code hereby adopted be declared for any reason to be invalid, it is the intent of the City of Everett that it would have passed all portions of this ordinance and the Code independent of the elimination of any such portion as may be declared invalid. Section 7: Savings. This ordinance shall not be construed nor held to repeal Ordinance No. 2361-99 or No. 2770-04 as to any offense committed against such former ordinance or as to any act done, any penalty, forfeiture or punishment so incurred or any right accrued or claim arising under the former ordinance, or in any way whatever to affect any such offense or act so committed or so done, or any penalty, forfeiture or punishment so incurred or any right accrued or claim arising before this ordinance takes effect. Nothing contained in this section shall be construed as abating any action now pending under or by virtue of Ordinance No. 2361-99 or No. 2770-04; or as discontinuing, abating, modifying or altering any penalty accrued or to accrue, or as affecting the liability of any person, form or corporation, or as waiving any right of the City under Ordinance No. 2361-99 or No. 2770-04 or provision thereof in force at the time of passage of this ordinance. Section 8: Ordinance No. 2770-04 (Chapter 16.10 EMC) and all other ordinances in conflict herewith are hereby repealed.
