Ordinance No. 3007-07 <br /> AN ORDINANCE providing for the adoption of the 200• <br /> Edition of the International Mechanical Code and the <br /> International Fuel Gas Code and repealing Ordinance No. <br /> 2772-04 (Everett Municipal Code Chapter 16.02). <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public <br /> health, safety and welfare; <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by <br /> this ordinance would create public harm and a public nuisance; <br /> WHEREAS, the City Council finds that the City is mandated by the State to <br /> implement and enforce the herein adopted code; <br /> WHEREAS, the City Council finds that it is appropriate for the Board of Review <br /> to have discretionary power to approve plans and a time frame for bringing existing <br /> buildings into compliance with the ordiance so long as the requirements are not waived <br /> and the time frame does not exceed one year; and <br /> WHEREAS, the City Council is aware that the 2006 editions of the International <br /> Mechanical Code and International Fuel Gas Code take effect in all counties and all cities <br /> on July 1, 2007; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Short title. This ordinance shall be known as the "Everett Mechanical <br /> Code." <br /> Section 2: International Mechanical Code adopted by reference <br /> The 2006 International Mechanical Code, as published by the International Code <br /> Council, as amended by Chapter 51-52 WAC and the 2006 International Fuel Gas <br /> Code, except that the standards for liquefied petroleum gas installations shall be <br /> NFPA 58 (Storage and Handling of Liquefied Petroleum Gases) and ANSI <br /> 2223.1/NFPA 54 (National Fuel Gas Code), being particularly the 2006 Editions <br /> thereof and the whole thereof, save and except such portions as are hereinafter <br /> deleted, modified or amended, and are hereby adopted by reference and <br /> incorporated herein as fully as if set out at length herein, collectively referred to <br /> as the "Code" unless specifically provided otherwise. <br /> Section 3: <br /> Section 101.3 amended—Purpose <br /> Section 101.3 of the 2006_Edition of the International Mechanical Code is hereby <br /> amended by the addition of the following language: <br /> A. It is the specific intent of these regulations to place the obligation of <br /> complying with these regulations upon the permit applicant and any person <br /> - i - <br />
