and 2006 International Fuel Gas Code hereby adopted be declared for any reason to be invalid, it is the intent of the City of Everett that it would have passed all portions of this ordinance and the Code independent of the elimination of any such portion as may be declared invalid. Section 9: Savings. This ordinance shall not be construed nor held to repeal Ordinance No. 2365-99 or No. 2772-04 as to any offense committed against such former ordinance or as to any act done, any penalty, forfeiture or punishment so incurred or any right accrued or claim arising under the former ordinance, or in any way whatever to affect any such offense or act so committed or so done, or any penalty, forfeiture or punishment so incurred or any right accrued or claim arising before this ordinance takes effect. Nothing contained in this section shall be construed as abating any action now pending under or by virtue of Ordinance No. 2365-99 or No. 2772-04; or as discontinuing, abating, modifying or altering any penalty accrued or to accrue, or as affecting the liability of any person, form or corporation, or as waiving any right of the City under Ordinance No. 2365-99 or No. 2772-04 or provision thereof in force at the time of passage of this ordinance. Section 10: Ordinance No. 2772-04 (Chapter 16.02 EMC) and all other ordinances in conflict herewith are hereby repealed.
