C. The enforcement provisions and procedures provided in this Code are not exclusive and the City if authorized to pursue any remedy it deems appropriate or as otherwise provided by law. D. The issuance or granting of a permit or approval of plans and/specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this Code or any other law or regulation. No permit presuming to give authority to violate or cancel the provisions of this Code shall be valid, except insofar as the work or use, which it authorized, is lawful. E. A The issuance or granting of a permit or approval of plans and/or specifications shall not prevent the Building official or designee from thereafter requiring the correction of errors in said plans and/or specifications or from preventing construction operation being carried on thereunder when in violation of this Code or of any other ordinance, law or regulations or from revoking any certificate of approval when issued in error. Section 7: Authority to Abate: A. Any violation of this chapter determined to exist after inspection by the Building Code Official is hereby declared to be nuisance. B. Where a nuisance exists, the city attorney on behalf of the city is authorized to institute injunction mandamus, or other appropriate action or proceeding to prevent the violation of this ordinance. C. Notwithstanding subsection B of this section, the city attorney is authorized to apply to any court of competent jurisdiction for and such court, upon hearing and for cause shown, may grant a temporary or permanent injunction restraining any person, firm, and/or corporation from violating any provision of this ordinance or the codes herein adopted and compelling compliance herewith. The cost of such action shall be taxed against the violator. Section 8: Severability. The City of Everett hereby declares that should any section, paragraph, sentence or word of this ordinance, the 2005 National Electrical Code hereby adopted be declared for any reason to be invalid, it is the intent of the City of Everett that it would have passed all portions of this ordinance and the Code independent of the elimination of any such portion as may be declared invalid. Section 9: Savings. This ordinance shall not be construed nor held to repeal Ordinance No. 2073-95 or No. 2364-99 as to any offense committed against such former ordinance or as to any act done, any penalty, forfeiture or punishment so incurred or any right accrued or claim arising under the former ordinance, or in any way whatever to affect any such offense or act so committed or so done, or any penalty, forfeiture or punishment so incurred or any right accrued or claim arising before this ordinance takes effect. Nothing contained in this section shall be construed as abating any action now pending under or by virtue of Ordinance No. 2073-95 or No. 2364-99; or as discontinuing, abating, modifying or altering any penalty accrued or to accrue, or as affecting the liability of any person, form or corporation, or as waiving any right of the City under -8-
