5 <br /> ORDINANCE NO. <br /> An Ordinance Amending the Zoning Code(EMC Title 19,as amended)Definition of <br /> "Clinic," and Repealing Sections 2, 4 and 5 of Ordinance No.2708-03. <br /> WHEREAS, the City Council finds the following: <br /> 1. The Everett Zoning Code currently allows only one opiate substitution treatment facility <br /> in the city; <br /> 2. Therapeutic Health Services,which operates the existing facility located in south Everett <br /> has requested that the City amend the Zoning Code to allow them to operate another <br /> facility in the city,which includes among other services, dispensing of methadone for <br /> opiate substitution treatment; <br /> 3. There is a significant need in Everett and Snohomish County for additional treatment <br /> capacity for persons suffering from addiction to opiates; <br /> 4. The Planning Commission conducted a public workshop on May 2,2017,to take public <br /> testimony concerning a proposed amendment to the Zoning Code to allow a second <br /> opiate substitution treatment facility in the city; <br /> 5. The Planning Commission conducted public hearings on June 20,2017,November 7, <br /> 2017, and on December 5,2017,to take additional public testimony and consider making <br /> a recommendation to the City Council; <br /> 6. The documented need for additional treatment for opiate addiction in Snohomish County, <br /> according to the Snohomish County Human Services Department,is most prominent in <br /> north Everett, Marysville, and Tulalip; <br /> 7. The existing opiate substitution treatment facility located in south Everett has operated <br /> successfully within a commercial corridor outside of downtown for approximately fifteen <br /> years,with minimal impact on the community; <br /> 8. The downtown Everett business community has expressed concerns about having an <br /> opiate substitution treatment facility in the downtown area,in part due to the already high <br /> concentration of social service use in downtown and potential for additional impacts to <br /> business from additional services locating downtown; <br /> 1 <br /> 16 <br />
