CITY OF EVERETT,WASHINGTON CONTRACT THIS CONTRACT is made and entered into this 6th day of February, 2018, by and between the City of Everett,Washington,a municipal corporation existing under the laws of the State of Washington, hereinafter called the "City", and Service Electric Co Inc, a corporation,hereinafter called the "Contractor." In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees to furnish all labor, tools, materials, equipment,and supplies required to build and construct in a workmanlike manner the work, improvements, and appurtenances in accordance with the Specifications and Plans entitled: ELECTRIC BUS CHARGER INFRASTRUCTURE INSTALLATION 3225 Cedar St., Everett,WA 98201 The following documents ("Contract Documents") are incorporated by reference and are hereby made a part of this Contract: A. Invitation to Bid B. Information for Bidders C. General and Special Conditions D. Technical Specifications and Contract Drawings E. Change Orders (if any) F. Addenda (if any) G. Bid Proposal submitted by the Contractor as to those items and/or alternatives accepted by the City (Conformed copy dated January 2, 2018.) H. Payment and Performance Bond I. All provisions required by law whether here inserted or not J. Project Plans and Drawings K. Supplemental Drawings L. Permits M. All provisions required by law whether set forth and reproduced herein or not The work shall be physically complete in all respects within forty-five (45) calendar days from the date of issuance of the Notice to Proceed. The parties agree the City will suffer damage and be put to additional expense in the event that the Contractor does not complete the work in all respects and have it ready for use by the physical completion date stated. Because it is difficult to accurately compute the amount of such costs and damages, the Contractor hereby covenants and agrees to pay to the City liquidated damages as computed in the Invitation to Bid, for each and every calendar day required to accomplish physical completion of the work in excess of the period established above for physical completion. It is hereby agreed that damages for Contractor delay shall be deducted from payment due the Contractor or deducted from any sums retained for benefit of employees, subcontractors, or suppliers provided the City's claim shall be subject to claims filed against the retained percent. The amount of this contract is One Hundred Eighty-One Thousand One Hundred Fourteen Dollars and Seventy Cents($181.114.70) and is based on the bid submitted by the Contractor dated January 2,2018.
