CITY OF EVERETT,WASHINGTON <br /> CONTRACT <br /> THIS CONTRACT is made and entered into this 6th day of February, 2018, by and between the City of <br /> Everett,Washington,a municipal corporation existing under the laws of the State of Washington, <br /> hereinafter called the "City", and Service Electric Co Inc, a corporation,hereinafter called the <br /> "Contractor." <br /> In consideration of the sums to be paid to it by the City, Contractor hereby covenants and agrees to <br /> furnish all labor, tools, materials, equipment,and supplies required to build and construct in a <br /> workmanlike manner the work, improvements, and appurtenances in accordance with the Specifications <br /> and Plans entitled: <br /> ELECTRIC BUS CHARGER INFRASTRUCTURE INSTALLATION <br /> 3225 Cedar St., Everett,WA 98201 <br /> The following documents ("Contract Documents") are incorporated by reference and are hereby made a <br /> part of this Contract: <br /> A. Invitation to Bid <br /> B. Information for Bidders <br /> C. General and Special Conditions <br /> D. Technical Specifications and Contract Drawings <br /> E. Change Orders (if any) <br /> F. Addenda (if any) <br /> G. Bid Proposal submitted by the Contractor as to those items and/or alternatives accepted <br /> by the City (Conformed copy dated January 2, 2018.) <br /> H. Payment and Performance Bond <br /> I. All provisions required by law whether here inserted or not <br /> J. Project Plans and Drawings <br /> K. Supplemental Drawings <br /> L. Permits <br /> M. All provisions required by law whether set forth and reproduced herein or not <br /> The work shall be physically complete in all respects within forty-five (45) calendar days from the date <br /> of issuance of the Notice to Proceed. The parties agree the City will suffer damage and be put to additional <br /> expense in the event that the Contractor does not complete the work in all respects and have it ready for <br /> use by the physical completion date stated. Because it is difficult to accurately compute the amount of such <br /> costs and damages, the Contractor hereby covenants and agrees to pay to the City liquidated damages as <br /> computed in the Invitation to Bid, for each and every calendar day required to accomplish physical <br /> completion of the work in excess of the period established above for physical completion. It is hereby <br /> agreed that damages for Contractor delay shall be deducted from payment due the Contractor or deducted <br /> from any sums retained for benefit of employees, subcontractors, or suppliers provided the City's claim <br /> shall be subject to claims filed against the retained percent. <br /> The amount of this contract is One Hundred Eighty-One Thousand One Hundred Fourteen Dollars and <br /> Seventy Cents($181.114.70) and is based on the bid submitted by the Contractor dated January 2,2018. <br />
