ORDINANCE NO. 3598-18 <br /> An Ordinance Amending the Zoning Code (EMC Title 19, as amen • <br /> /i*//ild. Wilma <br /> Definition of"Clinic," and Repealing Sections 2, 4 and 5 of Ordinanc • <br /> 2708-03,Amending Ordinance No. 2397-99 (as amended), and Prohib E-4/H -SETT <br /> Clinics in the B-3 (Central Business District) Zone. <br /> WHEREAS, the City Council finds the following: <br /> 1. Under current federal case law, local zoning regulations may not treat facilities that provide <br /> services for disabled persons, including persons recovering from opiate addiction, differently <br /> than they treat services for non-disabled persons; <br /> 2. Staff has identified zoning code amendments that would update City regulations consistent <br /> with Federal law pertaining to opiate substitution treatment facilities and make it clear that <br /> such facilities are permitted in any zone in which clinics are allowed; <br /> 3. In the course of their deliberations, the planning Commission and City Council have <br /> examined whether medical clinics are an appropriate use in the B-3 zone under the City's <br /> zoning code. <br /> 4. Council believes it is prudent to prohibit all clinics in the B-3 zone until it has had an <br /> opportunity to receive additional information from staff and input from stakeholders. <br /> WHEREAS, the City Council concludes the following: <br /> 1. The proposed amendment to the Zoning Code is consistent with the Everett Growth <br /> Management Comprehensive Plan; <br /> 2. The proposed amendment bears a substantial relation to public health, safety or welfare; <br /> 3. The proposed amendment to the Zoning Code provides for the best long-term interests of <br /> the Everett community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 4 of Ordinance No. 1671-89, as amended by Section 3 of Ordinance No. <br /> 2708-03 (EMC 19.4.020), definition of"Clinic,"which reads as follows: <br /> "Clinic" means a building or portion of a building containing an office or offices of medical <br /> doctors, dentists, psychiatrists, chiropractors, physical therapists and other members of the <br />
