1 ORDINANCE NO. // 9 9 <br /> 2 <br /> AN ORDINANCE authorizing revision of policies to comply with FLSA <br /> 3 and amending the compensatory time section (14(F)) of Ordinance <br /> No. 805-81. <br /> 4 <br /> 5 WHEREAS, the Garcia decision makes FLSA applicable to City employees; <br /> 6 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 7 Section 1: The Mayor is authorized to revise personnel policies and procedures <br /> 8 for all employees as deemed necessary to comply with FLSA. <br /> 9 Section 2: Section 14(F) of Ordinance No. 805-81 which reads as follows: <br /> 10 <br /> 11 "F. Extra Compensation: Employees shall be entitled to <br /> straight compensatory time off for prior approved hours worked beyond <br /> 12 forty hours per week or beyond eight hours in any one day. In no case will <br /> accrued compensatory time be allowed to accumulate beyond forty hours. <br /> 13 Department heads shall not have this right but may be granted time off at <br /> the discretion of the Mayor." <br /> 14 <br /> 15 is hereby amended to read hereafter as follows: <br /> 16 "F. Compensatory Time: Compensatory time off shall be <br /> 17 arranged between supervisor and employee, at the discretion of the <br /> supervisor; provided that compensatory time off shall onlyl be taken in <br /> 18 accordance with the ordinances of the City and personnel policies <br /> promulgated by the Mayor." <br /> 19 <br /> • <br /> 20 �' . <br /> 21 WILLIAM E.
