Illumination. <br /> 2 Sufficient illumination shall be provided in and about the parts of <br /> any public place of adult entertainment premise which is open to and used <br /> 3 by the public so that all objects are plainly visible at all times. Such <br /> illumination shall be not less than ten (10) foot candles at floor level at all <br /> 4 times when the premises are open or when any member of the public is <br /> permitted to enter and remain therein. <br /> 5 <br /> 6 I. Exemptions. <br /> 7 This chapter shall not be construed to prohibit: <br /> 8 1. Plays, operas, musicals, or other dramatic works which are not <br /> obscene; <br /> 9 <br /> 2. Classes, seminars and lectures held for serious scientific or educa- <br /> 10 tional purposes; or <br /> 11 3. Exhibitions or dances which are not obscene. <br /> 12 For purposes of this chapter, any activity is "obscene": <br /> 13 1. Which the average person, applying contemporary community <br /> standards, would find, when considered as a whole, appeals to the <br /> 14 prurient interest; and <br /> 15 2. Which explicitly depicts or describes patently offensive representa- <br /> tions or descriptions of: <br /> 16 <br /> a. Ultimate sexual acts, normal or perverted, actual or <br /> 17 simulated; or <br /> 18 b. Masturbation, fellatio, cunnilingus, bestiality, excretory <br /> functions, or lewd exhibition of the genitals or genital area; <br /> 19 or <br /> 20 c. Violent or destructive sexual acts, including but not limited <br /> to human or animal mutilation, dismemberment, rape or <br /> 21 torture; and <br /> 22 3. Which, when considered as a whole, and in the context in which it <br /> is used, lacks serious literary, artistic, political, or scientific value. <br /> 23 <br /> For purposes of this chapter, an activity is "dramatic" if the <br /> 24 activity is of, relating to, devoted to, or concerned specifically or <br /> professionally with current drama or the contemporary theater. <br /> 25 <br /> 26 J. Taverns - Liquor Licenses. <br /> 27 Section G of this chapter does not apply to taverns and premises <br /> maintaining liquor licenses. <br /> 28 <br /> 29 K. Issuance of Licenses. <br /> 30 1. After an investigation, the Clerk shall issue the applicable license <br /> 31 or licenses authorized by this chapter if the Clerk finds: <br /> a. That the applicant complies with all of the requirements of <br /> 32 this chapter; and <br /> -5- <br />
