• <br /> 1 P. Code Violations and Enforcement. <br /> 2 <br /> The remedies provided herein for violations of or failure to comply <br /> 3 with provisions of this ordinance, whether civil or criminal, shall be <br /> cumulative and shall be in addition to any other remedy provided by law. <br /> 4 <br /> 5 Q. Severability. <br /> 6 If any provision of this chapter shall be declared unconstitutional <br /> or invalid by any court of competent jurisdiction, it shall be conclusively <br /> 7 presumed that this chapter would have been enacted without the provision <br /> so held unconstitutional or invalid and the remainder of this chapter shall <br /> 8 not be affected as a result of said part being held unconstitutional or <br /> invalid. <br /> 9 <br /> 10 R. Purpose. <br /> 11 It is expressly the purpose of this chapter to provide for and <br /> 12 promote the health, safety and welfare of the general public, and not to <br /> create or otherwise establish or designate any particular class or group of <br /> 13 persons who will or should be especially protected or benefited by the <br /> terms of this chapter. <br /> 14 It is the specific intent of this chapter that no provision nor any <br /> ]5 term used in this chapter is intended to impose any duty whatsoever upon <br /> the City or any of its officers or employees, for whom the implementation <br /> 16 or enforcement of this chapter shall be discretionary and not mandatory. <br /> 17 Nothing contained in this chapter is intended to be nor shall be <br /> construed to create or form the basis for any liability on the part of the <br /> 18 City, or its officers, employees or agents, for any injury or damage <br /> resulting from the failure of an applicant/licensee to comply with the <br /> 19 provisions of this chapter, or by reason or in consequence of any <br /> inspection, notice, order, certificate, permission or approval authorized or <br /> 20 issued or done in connection with the implementation or enforcement <br /> pursuant to this chapter, or by reason of any action or inaction on the part <br /> 21 of the City related in any manner to the enforcement of this chapter by <br /> its officers, employees or agents. <br /> 22 <br /> 23 S. Conflicting Sections or Provisions. <br /> 24 In the event there is a conflict or inconsistency between the <br /> sections and provisions set forth in this chapter and those set forth <br /> 25 elsewhere in Ordinance No. 295-74 (as amended), the sections and <br /> provisions of this chapter shall govern and supersede those set forth <br /> 26 elsewhere. <br /> 27 <br /> 28 Section 2: IMPLEMENTATION.
