- la <br /> ORDINANCE NO. // 9 5' <br /> AN ORDINANCE deleting Sections 4, 5, 6, 7 and <br /> 8 of Ordinance No. 1154-85 vacating a portion <br /> of Narbeck Road lying south of Mukilteo <br /> Boulevard. <br /> WHEREAS, on July 17, 1985, City Council passed Ordinance No. 1154-85 <br /> vacating a portion of Narbeck Road, lying south of Mukilteo Boulevard, and <br /> WHEREAS, the Ordinance retained an easement to the City of Everett <br /> togetherwith the right to grant to other utility companies an easement across <br /> the vacated right-of-way, and <br /> WHEREAS, the intent of retaining this right was to grant to Snohomish <br /> County P.U.D. #1 an easement for their existing overhead distribution system, <br /> and <br /> WHEREAS, Snohomish County P.U.D. No. 1 has negotiated a separate <br /> agreement from the property owner, therefore terminating the need to retain <br /> the easement condition within the ordinance. <br /> NOW THEREFORE, THE CITY OF EVERE T DOES ORDAIN: <br /> Section 1 : That Sections 4, 5, 6, 7, and 8 of said Ordinance No. <br /> 1154-85 which read as follows: <br /> "Section 4: That the City of Everett hereby retains an easement to <br /> construct, reconstruct, operate, maintain, repair and replace all <br /> utilities under, over and across the right-of-way: <br /> As herein described within Section 1 of this Ordinance. <br /> The City of Everett further retains the right to grant to public <br /> and private utilities the right to construct, reconstruct, operate, <br /> maintain, repair and replace existing or proposed utility lines <br /> including, but not limited to, telephone, gas and electrical, under, <br /> over and across the property above-described. The City further retains <br /> the right of access across adjacent properties for the purposes <br /> described herein". <br /> "Section 5: That at all times all activities conducted in and <br /> around the herein described easement shall be conducted so as not to <br /> interfere with, obstruct or endanger the usefulness of any <br /> improvements, or other facilities, now or hereafter maintained upon the <br /> easement or in any way interfere with, obstruct or endanger the City's <br /> use of the easement". <br />
