- la ORDINANCE NO. // 9 5' AN ORDINANCE deleting Sections 4, 5, 6, 7 and 8 of Ordinance No. 1154-85 vacating a portion of Narbeck Road lying south of Mukilteo Boulevard. WHEREAS, on July 17, 1985, City Council passed Ordinance No. 1154-85 vacating a portion of Narbeck Road, lying south of Mukilteo Boulevard, and WHEREAS, the Ordinance retained an easement to the City of Everett togetherwith the right to grant to other utility companies an easement across the vacated right-of-way, and WHEREAS, the intent of retaining this right was to grant to Snohomish County P.U.D. #1 an easement for their existing overhead distribution system, and WHEREAS, Snohomish County P.U.D. No. 1 has negotiated a separate agreement from the property owner, therefore terminating the need to retain the easement condition within the ordinance. NOW THEREFORE, THE CITY OF EVERE T DOES ORDAIN: Section 1 : That Sections 4, 5, 6, 7, and 8 of said Ordinance No. 1154-85 which read as follows: "Section 4: That the City of Everett hereby retains an easement to construct, reconstruct, operate, maintain, repair and replace all utilities under, over and across the right-of-way: As herein described within Section 1 of this Ordinance. The City of Everett further retains the right to grant to public and private utilities the right to construct, reconstruct, operate, maintain, repair and replace existing or proposed utility lines including, but not limited to, telephone, gas and electrical, under, over and across the property above-described. The City further retains the right of access across adjacent properties for the purposes described herein". "Section 5: That at all times all activities conducted in and around the herein described easement shall be conducted so as not to interfere with, obstruct or endanger the usefulness of any improvements, or other facilities, now or hereafter maintained upon the easement or in any way interfere with, obstruct or endanger the City's use of the easement".
