4. 1 ORDINANCE NO. /a.44-fc 2 3 AN ORDINANCE relating to the operation of off-highway vehicles, adding a new article to the Everett Criminal Code, Ordinance No. 1145-85. 4 5 6 WHEREAS, a large number of off-highway vehicles are being operated in the 7 City of Everett by persons without proper supervision; and 8 WHEREAS, many of the areas where off-highway vehicles are operated are 9 undeveloped and contain hazardous terrain; and 10 WHEREAS, the operation of many off-highway vehicles creates an unreasonable 11 amount of engine noise and dust, disturbing the peace, comfort and repose of property 12 owners living nearby; 13 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 14 Section 1: That an Article 20 entitled "Off-Highway Vehicles" shall be added 15 to the Everett Criminal Code, Ordinance No. 1145-85, to read as follows: 16 ARTICLE 20 17 OFF-HIGHWAY VEHICLES 18 Section 1: Definitions 19 "Off-highway vehicle" shall mean any self-propelled vehicle when used 20 for recreation travel on trails and nonhighway roads or for recreation cross-country travel on any one of the following or a combination thereof: 21 Land, water, snow, ice, marsh, swampland, and other natural terrain. Such vehicles shall include but are not limited to, two or four-wheel drive 22 vehicles, motorcycles, dune buggies, amphibious vehicles, ground effects or air cushion vehicles, and any other means of land transportation 23 deriving motive power from any source other than muscle or wind. 24 Off-highway vehicle does not include: 25 1. Any vehicle designed primarily for travel on, over, or in the water; or 26 2. Snowmobiles or any military vehicles. 27 28 Section 2: Operation of Off-Highway Vehicles Prohibited 29 Except as otherwise permitted by federal law, state law or City of Everett ordinance, it shall be a misdemeanor for any person to operate 30 any off-highway vehicle in the City of Everett. 31 32
