• <br /> 4 <br /> } <br /> the County to assure the quality of services necessary for the performance of any <br /> Contract. <br /> B. The Agency shall maintain registration with the Washington State Office of the <br /> Secretary of State. <br /> XII. SERVICES PROVIDED IN ACCORDANCE WITH LAW <br /> The Agency and the County shall comply with all applicable laws, rules, ordinances, <br /> codes, and regulations of local, state, and federal governments, as now existing or <br /> hereafter enacted or amended in the performance of any Contract. I <br /> XIII. PUBLIC RECORDS <br /> This Agreement and any Contract shall be considered a public document and will be <br /> available for inspection and copying by the public in accordance with the Public Records <br /> Act, chapter 42.56 RCW(the"Act"). <br /> XIV. COMPLIANCE WITH FUNDING SOURCE REQUIREMENTS <br /> The Agency shall comply with all conditions, terms and requirements of any funding <br /> source that wholly or partially funds the Agency's work under any Contract. <br /> XV. PROPRIETARY SOFTWARE APPLICATIONS <br /> In the event the Agency accesses the County's proprietary software applications to <br /> perform any work under any Contract, the Agency shall read and agree to the terms and <br /> conditions of the software license agreement, and shall not violate the terms and <br /> conditions of the software license agreement including, but not limited to: <br /> A. Restricting the use of the software application to employees or subcontractors; <br /> B. Not"pirating" or reverse engineering the software application; and/or <br /> C. Otherwise using the application in any way that may harm the County or violate the <br /> terms and conditions of the software license agreement. <br /> XVI. COMPLIANCE WITH SNOHOMISH COUNTY HUMAN RIGHTS ORDINANCE <br /> It is the policy of the County to reject discrimination which denies equal treatment to any <br /> individual because of his or her race, creed, color, national origin, families with children, <br /> sex, marital status, sexual orientation, age, honorably discharged veteran or military <br /> status, or the presence of any sensory,mental,or physical disability or the use of a trained <br /> dog guide or service animal by a person with a disability as provided in Washington's Law <br /> against Discrimination, Chapter 49.60 RCW, and the Snohomish County Human Rights <br /> Ordinance, Chapter 2.460 SCC. These laws protect against specific forms of <br /> discrimination in employment, credit transactions, public accommodation, housing, <br /> county facilities and services, and county contracts. <br /> The Agency shall comply with the substantive requirements of Chapter 2.460 SCC,which <br /> are incorporated herein by this reference. Execution of this Agreement constitutes a <br /> certification by the Agency of the Agency's compliance with the requirements of Chapter <br /> 2.460 SCC. If the Agency is found to have violated this provision, or to have furnished <br /> false or misleading information in an investigation or proceeding conducted pursuant to <br /> this Agreement or Chapter 2.460 SCC, this Agreement may be subject to a declaration <br /> Basic Terms and Conditions Agreement <br /> City of Everett <br /> HSD-2018-101-198 <br /> Page 8 of 31 <br /> 33 <br />
