The Agency may be required to provide additional safeguards and acknowledgment <br /> of recipient rights under HIPAA, in accordance with the Agency's independent HIPAA <br /> obligations or those required by any Contract. <br /> XXI. BACKGROUND CHECKS <br /> A. Any Agency which has a Contract to provide services, housing, or otherwise care for <br /> vulnerable adults, developmentally disabled persons,juveniles, or children, or provide <br /> child day care, early learning, or early childhood education services shall ensure all rx <br /> staff and volunteers have a background check on file as per RCW 43.43.830- <br /> 43.43.845. <br /> B. A background check must be completed at the time of employment or commencement <br /> of volunteer duties. <br /> C. If circumstances arise that cause a provider to question the need for another <br /> background check, they are encouraged to implement another check. All persons <br /> convicted of crimes listed in RCW 43.43.830 and RCW 43.43.842 are prohibited from <br /> having access to program participants. <br /> XXII. TREATMENT OF CLIENT ASSETS <br /> Unless otherwise provided in any Contract, the Agency shall ensure that any adult client <br /> receiving services from the Agency under any Contract has unrestricted access to the <br /> client's personal property. The Agency shall not interfere with any adult client's <br /> ownership, possession, or use of the client's property. The Agency shall provide clients <br /> under age eighteen (18) with reasonable access to their personal property that is <br /> appropriate to the client's age, development, and needs. Upon termination or expiration <br /> of any Contract, the Agency shall immediately release to the client and/or the client's <br /> guardian or custodian all of the client's personal property. This section does not prohibit <br /> the Agency from implementing such lawful and reasonable policies, procedures and <br /> practices as the Agency deems necessary for safe, appropriate, and effective service <br /> delivery(for example, appropriately restricting clients' access to, or possession or use of, <br /> lawful or unlawful weapons and drugs). <br /> XXIII. REPORTS <br /> The Agency shall timely provide to the County and to any state or federal funding agency <br /> such financial, program, and other reports, in such formats as required by this Agreement <br /> or any Contract. <br /> XXIV. MAINTENANCE OF RECORDS <br /> A. The Agency shall retain for a period of six (6) years from the termination of any <br /> Contract unless required otherwise by law: <br /> 1. All financial, statistical, participant, and other records (including medical and <br /> treatment records) and supporting documentation; <br /> 2.
