• <br /> (K ,1f <br /> ORDINANCE NO. /p73- 1jr <br /> AN ORDINANCE amending the Zoning Map of <br /> the City of Everett as provided by Ordinance <br /> No. 3572, as amended (Title 19, Everett Municipal <br /> Code) to encompass an area southeast of Lowell, including <br /> a portion of the Lowell Snohomish River Road. <br /> WHEREAS, the City Council finds that on June 25, 1985, the Everett <br /> Planning Commission held a public hearing regarding establishment of the <br /> zoning designation for the hereinafter described property annexed to the City; <br /> and <br /> WHEREAS, the City Council of Everett, after hearing the recommendations <br /> of the Planning Commission at a public hearing on 5PT.�Si (e ij, 1985, has <br /> determined that Rural Environment land uses, as per City of Everett Shoreline <br /> Master Program for said property, shall be effective upon annexation to the <br /> City; and <br /> WHEREAS, the City Council of Everett, after hearing the recommendation <br /> of the Planning Commission has determined that said property shall be zoned <br /> Floodway District as per E.M.C. 19.11.040. <br /> NOW, THEREFORE, THE City of Everett does ordain: <br /> Section 1: That the City Council of Everett does hereby find that the <br /> zoning designation hereinafter set forth is in the best interest of the <br /> City of Everett and meets the purpose of the Comprehensive Plan. <br /> Section 2: That the Zoning Map of the City of Everett, as established <br /> by Everett Municipal Code, Title 19 (Ord. No. 3572, Sec. 4, as amended) <br /> is hereby amended to include and designate said property Floodway <br /> District (FW) as described below: <br /> A portion of the Northeast Quarter of Section 5, Township 28 <br /> North, Range 5 East, W.M., situated in Snohomish County, State of <br /> Washington, described as follows: <br /> Beginning at the, southwest corner of the East Half of the <br /> Northeast Quarter of said Section 5; thence easterly along the <br /> south line of said subdivision to the East one-quarter (1/4) <br /> corner of said Section 5; thence northerly along the east line of <br /> said Section 5 to the centerline of the Snohomish River; thence <br /> westerly along the centerline of the Snohomish River to the <br /> intersection of the projected east line of the plat of Town of <br /> Lowell, according to the plat thereof recorded in Volume 1 of <br /> Plats, Page 11, records of said County; thence southerly along <br /> the projected east line and the east line of said plat of Town of <br /> Lowell to the northeasterly corner of the plat of Smith's First <br /> Addition vacated portion, according to the plat thereof recorded <br /> in Volume 3 of Plats, Page 18, records of said County; thence <br /> continuing southerly along that vacated portion of said plat of <br /> Smith's First Addition to the southeasterly corner of said plat; <br /> thence southwesterly along the southerly line of said vacated <br /> portion of Smith's First Addition to the intersection of the west <br /> line of the East Half of the Northeast Quarter of said Section 5, <br /> said point also bears northerly from the Point of Beginning; <br /> thence southerly along the west line of said East Half to the <br /> point of Beginning; <br />
