0) gS <br /> • • , , r • <br /> ORDINANCE NO. ///p <br /> AN ORDINANCE regulating the disclosure of sewage system discharge <br /> information and amending Ordinance No. 801-81. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Ordinance No. 801-81 is hereby amended by the addition of <br /> the following section: <br /> Confidential Information. <br /> Information furnished to the City with respect to the source of materials <br /> discharged into the City's sewage system by a licensed discharger is <br /> exempt from public inspection per Ordinance No. 313-74 (as amended) <br /> because such information is proprietary information of the discharger and <br /> disclosure would violate the discharger's right to privacy and would result <br /> in an unfair competitive disadvantage to the discharger. <br /> All other information and data furnished to the City with respect to the <br /> nature and frequency of discharge shall be available to the public or other <br /> governmental agency without restriction unless the release of such <br /> information is entitled to protection per Ordinance No. 313-74 (as <br /> amended); provided, however, all such portions of a report shall be <br /> available for use by the State or City in judical review or enforcement <br /> proceedings involving the discharger who has furnished the report. <br /> WILLIAM E.
