ORDINANCE NO. /167—a5 AN ORDINANCE providing for the vacation of the Alley lying South of 17th Street and East of Rockefeller. WHEREAS, the City Council of the City of Everett, did by Resolution No.a6G4 , duly adopt and fix the 18th day of September, 1985, at 7:00 p.m. , as the date for public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described alley were heard and discussed; and WHEREAS, the above described alley was previously vacated on October 21, 1908 (Ordinance No. 960) to the Everett School District, subject to a reversionary interest if "the abutting properties are disposed by the School District to be used for private purposes; and WHEREAS, the Everett School District No. 2 has declared their site as surplus to the existing and foreseeable needs of the school district, and as such, intends to dispose of the site; and WHEREAS, it now appears to the City Council of the City of Everett that the said alley (reversionary interest) resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance;
