provision that a written notice of cancellation or reduction <br /> in coverage of said policy shall be delivered to the City <br /> thirty (30) days in advance of the effective date thereof ; <br /> if such insurance is provided by a policy which also covers <br /> Franchisee or any other entity or person other than those <br /> above named, then such policy shall contain the standard <br /> cross-liability endorsement. <br /> Section 47. Performance Bond. <br /> The Franchisee shall promptly repair or cause to be <br /> repaired, any damage to City property of every type caused <br /> by the Franchisee, or any agent or firm acting on behalf of <br /> the Franchisee, during the life of the Franchise. Franchisee <br /> shall comply with all present and future ordinances and <br /> regulations of the City regarding excavation or construction, <br /> provided that any such future ordinance or regulation shall <br /> be reasonable. Whenever deemed necessary by the City, Fran- <br /> chisee shall be required to post a performance bond, in an <br /> amount of Twenty-five Thousand Dollars ( $25,000) , in favor of <br /> the City warranting, among other things, that all restoration <br /> work will be done promptly and in a workmanlike manner. <br /> Section 48. Severability. <br /> Each section, subsection, or other portion of this <br /> Ordinance shall be severable and the invalidity of any <br /> section, subsection, or other portion shall not invalidate <br /> the remainder. <br /> Section 49. Discounts. <br /> Franchisee shall provide special rate discounts to <br /> low income senior Subscribers or low income permanently <br /> disabled Subscribers as follows: <br /> (a ) Eligibility. The eligibility for the special rate <br /> considerations set forth in this section shall be <br /> limited to those Subscribers who qualify as a "low <br /> income senior" or as "low income permanently disabled" <br /> under the City's prevailing standards and procedures. <br /> As of the date of this Ordinance, "low income" shall <br /> mean a person whose annual gross income is Seven <br /> Thousand Dollars ( $7,000.00) or less, as determined by <br /> the City of Everett. A senior citizen is defined as a <br /> person who is sixty-two (62) years of age or older. A <br /> person who is "permanently disabled" is a person who <br /> has been determined by the City of Everett to be <br /> permanently disabled and eligible for utility discounts <br /> by the City of Everett. The low income Subscriber must <br /> also be the owner-occupant of a single family residence <br /> or the legally responsible lessee of a rental residential <br /> unit. <br /> (b) Basic Rates. Franchisee will provide an 8. 50% <br /> discount in basic rates as defined in Section 5 of the <br /> Franchise Ordinance to Subscribers who are eligible <br /> under Subsection 49 (a ) above. In determining the <br /> amount of basic rate discount, the Franchisee may take <br /> into consideration bulk or other applicable rate dis- <br /> counts so that the total rate discount will not exceed <br /> 8. 50% for any Subscriber. <br /> (c) Free Installation. Franchisee will waive the basic <br /> installation fee for those residences within one hundred <br /> fifty (150) feet of Franchisee' s distribution system for <br /> Subscribers who are eligible under Subsection 49 (a) above. <br /> (d) Future Income Adjustment. In the event the <br /> City of Everett may subsequently increase the $7,000 <br /> ORDINANCE - 16 <br /> 5-21-85 <br />
