ORD X.NANCZ.NO. 1138-85 <br /> • <br /> THE CITY COUNCIL OF THE CITY OF EVERETT DOES ORDAIN AS FOLLOWS : <br /> Section 1 . Definitions. <br /> (a ) "Act" means the Cable Communications Policy Act <br /> of 1984. <br /> (b) "Applicant" means any person or entity that <br /> applies for a Franchise. <br /> (c ) "Basic Services" means those broadcast and non- <br /> broadcast services provided by the Franchisee at the <br /> lowest monthly charge and consisting of over-the-air <br /> broadcast signals mandated by the FCC, access and/or <br /> community channels, and any other distant retransmis- <br /> sion and/or satellite services selected by the Franchisee. <br /> (d) "Cable Communications System" or "system, " means a <br /> system of antennas, cables, wires, lines, towers, trans- <br /> mission lines, equipment or facilities described in <br /> Section 602 (6 ) of the Act, designed and constructed for <br /> the purpose of producing, receiving, transmitting, <br /> amplifying, scrambling and distributing audio, video and <br /> other forms of electronic or electrical signals, located <br /> in whole or in part in the City. <br /> (e) "Channel" means a single path or section of the <br /> spectrum which carries a television signal. <br /> (f ) "City" means the City of Everett, a municipal <br /> corporation of the State of Washington. <br /> (g ) "Community Programming" means any channel or <br /> portion of a channel which the local Franchisee offers <br /> for public, educational, or governmental use, including <br /> locally produced or otherwise acquired programming. <br /> (h) "Converter" means an electronic channel selector <br /> device which enables a Subscriber to view unscrambled <br /> cable television signals on a television receiver. <br /> (i ) "Council" means the present governing body of the <br /> City or any future board constituting the legislative <br /> body of the City. • <br /> (j ) "Descrambler" means electronic equipment which <br /> converts an electronically scrambled picture into a <br /> viewable signal. <br /> (k) "FCC" means the Federal Communications Commission, <br /> a regulatory agency of the United States Government. <br /> (1 ) "Franchise" means the non-exclusive right or <br /> authority to construct, operate and maintain a Cable <br /> Communications System within the City by use of City <br /> owned rights-of-way, easements or other publicly owned <br /> properties. <br /> (m) "Franchisee" means the person, firm or corporation <br /> to whom or which a Franchise, as hereinabove defined, <br /> is granted by the Council under this Ordinance and the <br /> lawful successor, transferee or assignee of said <br /> person, firm or corporation. <br /> (n) "Gross Subscriber Revenues" means income collected <br /> by Franchisee for the provision of Cable Communications <br /> Service; including Basic Service, Premium Services, <br /> ORDINANCE - 1 <br /> 5-21-85 <br />
