ORD X.NANCZ.NO. 1138-85 • THE CITY COUNCIL OF THE CITY OF EVERETT DOES ORDAIN AS FOLLOWS : Section 1 . Definitions. (a ) "Act" means the Cable Communications Policy Act of 1984. (b) "Applicant" means any person or entity that applies for a Franchise. (c ) "Basic Services" means those broadcast and non- broadcast services provided by the Franchisee at the lowest monthly charge and consisting of over-the-air broadcast signals mandated by the FCC, access and/or community channels, and any other distant retransmis- sion and/or satellite services selected by the Franchisee. (d) "Cable Communications System" or "system, " means a system of antennas, cables, wires, lines, towers, trans- mission lines, equipment or facilities described in Section 602 (6 ) of the Act, designed and constructed for the purpose of producing, receiving, transmitting, amplifying, scrambling and distributing audio, video and other forms of electronic or electrical signals, located in whole or in part in the City. (e) "Channel" means a single path or section of the spectrum which carries a television signal. (f ) "City" means the City of Everett, a municipal corporation of the State of Washington. (g ) "Community Programming" means any channel or portion of a channel which the local Franchisee offers for public, educational, or governmental use, including locally produced or otherwise acquired programming. (h) "Converter" means an electronic channel selector device which enables a Subscriber to view unscrambled cable television signals on a television receiver. (i ) "Council" means the present governing body of the City or any future board constituting the legislative body of the City. • (j ) "Descrambler" means electronic equipment which converts an electronically scrambled picture into a viewable signal. (k) "FCC" means the Federal Communications Commission, a regulatory agency of the United States Government. (1 ) "Franchise" means the non-exclusive right or authority to construct, operate and maintain a Cable Communications System within the City by use of City owned rights-of-way, easements or other publicly owned properties. (m) "Franchisee" means the person, firm or corporation to whom or which a Franchise, as hereinabove defined, is granted by the Council under this Ordinance and the lawful successor, transferee or assignee of said person, firm or corporation. (n) "Gross Subscriber Revenues" means income collected by Franchisee for the provision of Cable Communications Service; including Basic Service, Premium Services, ORDINANCE - 1 5-21-85
