1 ORDINANCE NO. //35- <br /> 2 <br /> /35 2 AN ORDINANCE establishing a payment deferral option for connection <br /> 3 charges under Ordinance No. 984-83 (EMC 14.08.135). <br /> 4 WHEREAS, the City Council of the City of Everett finds that sewer connections <br /> 5 are almost always made to new construction prior to substantial completion and <br /> 6 occupancy; and <br /> 7 WHEREAS, the Council further finds that deferral of payments of the special <br /> 8 sewer connection charge under Ordinance No. 984-83 in excess of $5,000 prior to <br /> 9 occupancy of new construction may assist new construction financing in Everett <br /> 10 without adversely affecting the City's administrative procedures; <br /> 11 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 12 Section 1: There is hereby established a limited deferral option payment of <br /> 13 amounts in excess of $5,000 assessed as special sewer connection charges under <br /> 14 Ordinance No. 984-83 (EMC 14.08.135). Granting of said option shall be subject to the <br /> 15 following minimum conditions: <br /> 16 <br /> A. Deferral applicants shall submit a covenant running with the land <br /> 17 enforceable against the owner or successors-in-interest on a form <br /> approved by the City Attorney and agreeing, as a minimum, that <br /> 18 the deferred balance may be enforceable as a sewer lien (without <br /> limitation as to other remedies). <br /> 19 <br /> B. All deferral applicants shall pay a $50 processing fee. <br /> 20 <br /> C. The City reserves the right to make reasonable credit investiga- <br /> 21 tions for the objective only of reasonable assurance of payment and <br /> to vary the conditions of the deferral agreement in order to secure <br /> 22 payment. <br /> 23 D.
