ti <br /> • <br /> 1 ORDINANCE NO. //6"? <br /> 5 <br /> 2 <br /> AN ORDINANCE providing for the licensing of "panorams," "previews," <br /> 3 "picture arcades," or "peep shows"; regulating the arrangement of <br /> the interior and the conditions upon the premises; restricting <br /> 4 lawful access to persons 18 years of age or older; requiring that the <br /> premises remain available to routine regulatory inspection by the <br /> 5 City; amending Ordinance No. 295-74 by the addition of a new <br /> chapter and repealing Section 2 of Ordinance No. 508-78 and <br /> 6 Section 109 of Ordinance No. 466A-77. <br /> 7 <br /> 8 THE CITY OF EVERETT DOES ORDAIN: <br /> 9 Section 1: Ordinance No. 295-74 is hereby amended by the addition of a new <br /> 10 chapter regulating "panorams," "previews," "picture arcades" or "peep shows," to be <br /> 11 entitled "Panorams, Previews, Picture Arcades and Peep Shows" which chapter shall <br /> 12 read as follows: <br /> 13 <br /> A. Definitions. <br /> 14 <br /> As used in this chapter, the following words and phrases shall have <br /> 15 the following meanings unless the context clearly requires otherwise: <br /> 16 1. "Clerk" means the City of Everett employee or agent appointed by <br /> the Mayor as licensing official under this chapter. <br /> 17 <br /> 2. "Panoram," "preview," "picture arcade" or "peep show," means any <br /> 18 device which, for payment of a fee, membership fee, or other <br /> charge, is used to exhibit or display a picture, view, or other <br /> 19 graphic display. All such devices are denominated in this chapter <br /> by the terms "panoram" or "panoram device." The terms panoram <br /> 20 and panoram device as used in this chapter do not include games <br /> which employ pictures, views or video displays, or gambling devices <br /> 21 regulated by the state or by Chapter 5.12 EMC. <br /> 22 3. "Panoram premises" means any premises or portion of any premises <br /> on which any panoram device is located and to which members of <br /> 23 the public are admitted. The term panoram premises as used in <br /> this chapter does not include movie or motion picture theater <br /> 24 auditoriums capable of seating more than five people. <br /> 25 4. "Panoram station" means the portion of any panoram premises on <br /> which a panoram device is located and from which the panoram <br /> 26 picture, view or graphic display is to be viewed. <br /> 27 <br /> B. Panoram Premises License Required. <br /> 28 <br /> 1. It is unlawful to display, exhibit, expose or maintain upon any <br /> 29 premises to which members of the public are admitted any <br /> panoram device without a valid and current license for such <br /> 30 premises, to be designated a "Panoram Premises License." <br /> 31 2. A separate license is required for each panoram premises and the <br /> same shall at all times be conspicuously posted and maintained <br /> 32 therein. <br />
