• <br /> S. State Environmental Policy Act Project Review/7,oning Code Site <br /> Plan Review <br /> 1. Threshold Determination of an Environmental Checklist <br /> a. Valuation of one million dollars or less by Building <br /> Official - One Hundred Dollars <br /> b. Valuation of over one million dollars by Building <br /> Official - Two Hundred Dollars <br /> c. Checklist with other land use applications - No fee <br /> 2. Environmental Impact Statement <br /> a. Submittal of Preliminary Draft EIS - Five hundred <br /> Dollars <br /> b. Additional costs, if any, incurred by the City, shall <br /> be billed directly to the applicant; no additional <br /> costs may be charted for existing studies or general <br /> information already in the possession of the City; <br /> and provided that in no event shall the cost for an <br /> EIS review exceed $2,000. No fee shall be required <br /> under this section for proposals primarily involving <br /> the construction of publicly subsidized housing. <br /> c. In the event that a proposal is modified so that an <br /> EIS is no longer required, the responsible official <br /> shall refund any costs collected under Section 3 <br /> above which were collected for costs not incurred. <br /> 3. The full fee for a threshold determination and/or an EIS <br /> shall be paid by the private applicant prior to the <br /> circulation of an EIS by the City. <br /> 4. No fee shall be collected by the City for performing its <br /> duties as a consulted agency. <br /> 5. Appeals - Fifty Dollars <br /> Section 2: REPEAL CONFLICTING ORDINANCE PROVISIONS: The fee <br /> provisions of any ordinances in conflict herewith are hereby repealed. <br /> Section 3: SEVERABILITY: If any provisions of this ordinance shall be <br /> declared unconstitutional or invalid by any court of competent jurisdiction, <br /> it shall be conclusively presumed that this ordinance would have been enacted <br /> without this provision so held unconstitutional or invalid and the remainder <br /> of this ordinance shall not be affected as a result of said part being held <br /> unconstitutional or invalid. <br /> Section 4: EFFECTIVE DATE: This ordinance shall be effective fifteen <br /> (15) days after becoming valid. <br /> WILLIAM E.
