1 H. Shorelines means all the water areas of the City and their associated wetlands under jurisdiction of the Shoreline Act, 2 together with the land underlying them, including: 3 1. That portion of Silver Lake within the corporate limits of the City and at least 200 feet upland from ordinary 4 high-water mark. (The associated wetland area.) 5 2. That portion from Weyerhaeuser Mill A to the fuel storage tanks at Mukilteo lying between the extreme low tide and 6 the ordinary high-water mark and at least 200 feet upland from the ordinary high-water mark (and the associated 7 wetland areas). 8 I. Shorelines of State-Wide Significance within the City of Everett consist of: 9 1. All of the water area of Port Gardner Bay lying seaward of 10 the line of extreme low tide, out of the City limits in mid-channel. 11 2. The Snohomish River and its associated wetlands at least 12 200 feet upland of ordinary high-water mark. 13 J. Shorelines of Everett are the total of all "Shorelines" and "Shorelines of State-Wide Significance" within the City. 14 K. Substantial Development means any development of which the 15 total cost of fair market value exceeds $1,000, or any development having an interrelated effect on both uplands and "Shorelines of 16 Everett," or any development which materially interferes with normal public use of the water or shorelines of Everett. 17 L. Substantial Progress towards construction shall include, but not be 18 limited to the letting of bids, making of contracts, purchase of material involved in development, but shall not include develop- 19 ment or uses which are inconsistent with the criteria set forth in 20 Section 19.64.050, provided, that in determining the running of the two-year period, there shall not be included the time during which 21 a development was not actually pursued by construction and the pendency of litigation reasonably related there to make it reason- 22 able not to so pursue. M. Wetlands or Wetland Areas means those lands extending landward 23 for at least 200 feet in all directions, as measured on a horizontal 24 plane from the ordinary high-water mark of Silver Lake, Port Gardner Bay, and the Snohomish River, and all marshes, swamps, 25 floodways, river deltas, and flood plains associated with the above areas. The wetland area shall not be greater than the 100-year 26 flood plain boundary as established by Everett's Flood Insurance Study per HUD Guidelines. 27 28 be and the same is hereby amended to read as follows: 29 Definitions: The following definitions are applicable to this ordinance: 30 A.
