1 H. Shorelines means all the water areas of the City and their <br /> associated wetlands under jurisdiction of the Shoreline Act, <br /> 2 together with the land underlying them, including: <br /> 3 1. That portion of Silver Lake within the corporate limits of <br /> the City and at least 200 feet upland from ordinary <br /> 4 high-water mark. (The associated wetland area.) <br /> 5 2. That portion from Weyerhaeuser Mill A to the fuel storage <br /> tanks at Mukilteo lying between the extreme low tide and <br /> 6 the ordinary high-water mark and at least 200 feet upland <br /> from the ordinary high-water mark (and the associated <br /> 7 wetland areas). <br /> 8 I. Shorelines of State-Wide Significance within the City of Everett <br /> consist of: <br /> 9 <br /> 1. All of the water area of Port Gardner Bay lying seaward of <br /> 10 the line of extreme low tide, out of the City limits in <br /> mid-channel. <br /> 11 <br /> 2. The Snohomish River and its associated wetlands at least <br /> 12 200 feet upland of ordinary high-water mark. <br /> 13 J. Shorelines of Everett are the total of all "Shorelines" and <br /> "Shorelines of State-Wide Significance" within the City. <br /> 14 <br /> K. Substantial Development means any development of which the <br /> 15 total cost of fair market value exceeds $1,000, or any development <br /> having an interrelated effect on both uplands and "Shorelines of <br /> 16 Everett," or any development which materially interferes with <br /> normal public use of the water or shorelines of Everett. <br /> 17 <br /> L. Substantial Progress towards construction shall include, but not be <br /> 18 limited to the letting of bids, making of contracts, purchase of <br /> material involved in development, but shall not include develop- <br /> 19 ment or uses which are inconsistent with the criteria set forth in <br /> 20 Section 19.64.050, provided, that in determining the running of the <br /> two-year period, there shall not be included the time during which <br /> 21 a development was not actually pursued by construction and the <br /> pendency of litigation reasonably related there to make it reason- <br /> 22 able not to so pursue. <br /> M. Wetlands or Wetland Areas means those lands extending landward <br /> 23 for at least 200 feet in all directions, as measured on a horizontal <br /> 24 plane from the ordinary high-water mark of Silver Lake, Port <br /> Gardner Bay, and the Snohomish River, and all marshes, swamps, <br /> 25 floodways, river deltas, and flood plains associated with the above <br /> areas. The wetland area shall not be greater than the 100-year <br /> 26 flood plain boundary as established by Everett's Flood Insurance <br /> Study per HUD Guidelines. <br /> 27 <br /> 28 be and the same is hereby amended to read as follows: <br /> 29 Definitions: The following definitions are applicable to this ordinance: <br /> 30 A. Act means the Shoreline Management Act of 1971, Chapter 90.58 <br /> 31 RCW. <br /> 32 <br /> -2- <br />
