• <br /> • <br /> 1 For purposes of the Writ proceedings, the petitioner shall be responsible <br /> for transcribing the record and shall bear the costs of said transcription. <br /> 2 Provided, however, appeals from City Council decisions on shoreline <br /> management substantial development permits shall be taken to the <br /> 3 Shoreline Hearings Board pursuant to the provisions of RCW 90.58. <br /> However, in the event of an appeal from any decision approving or <br /> 4 disapproving any plat, standing to bring an action for review in Superior <br /> Court shall be limited to those parties defined in RCW 58.17.180 and the <br /> 5 application for a writ of review shall be made to the court within the time <br /> specified in RCW 58.17.180. <br /> 6 <br /> 7 Section 5: That Section 22 of Ordinance No. 692-80 now reads as follows: <br /> 8 <br /> Section 22: HEARING EXAMINER'S QUARTERLY REPORT. <br /> 9 <br /> The Examiner shall report in writing to and meet with both the Planning <br /> 10 Commission and the City Council at least quarterly for the purpose of <br /> reviewing the administration of the City's land use policies and regulatory <br /> 11 ordinances. Such report shall include a summary of the Examiner's <br /> decisions since the last quarterly Examiner's report. <br /> 12 <br /> 13 be and the same is hereby amended to read as follows: <br /> 14 <br /> Section 22: HEARING EXAMINER'S SEMI-ANNUAL REPORT. <br /> 15 <br /> 16 The Examiner shall report in writing to and meet with both the City <br /> Council and Planning Commission semi-annually (first and third quarters <br /> 1 of the calendar year) for the purpose of reviewing the administration of <br /> 7 the City's land use policies and regulatory ordinances. Such report shall <br /> 18 include a summary of the Examiner's decisions since the last Examiner's <br /> report. <br /> 19 <br /> 20 Section 6: That Section 16 of Ordinance No. 692-80 as amended by Section 4 <br /> 21 of Ordinance No. 819-81 reads as follows: <br /> 22 Section 16: PUBLIC HEARING. <br /> 23 Before rendering a decision or recommendation on any application, the <br /> 24 examiner shall hold at least one public hearing thereon. Notice of the <br /> time and place of the public hearing shall be given as provided in the <br /> 25 ordinance governing the application. If none is specifically set forth, such <br /> notice shall be given at least ten working days prior to such hearing by <br /> 26 mailing notification to property owners per County Assessor records <br /> within five hundred feet (500') of the subject property and identified <br /> 27 neighborhood groups who have requested notice of land use matters. The <br /> applicant shall have the responsibility of providing the City with a list of <br /> 28 said property owners at his own expense and said list shall contain the <br /> true address of the property owner and not the address of a mortgage <br /> 29 lending company. If the true address cannot be ascertained, the address <br /> of the property shall be accepted; provided, however, any request for a <br /> 30 variance, special exception or appeal which is subject exclusively to the <br /> provisions of the Everett Municipal Code, Chapters 13.15 or 13.68, shall <br /> 31 be exempt from the provisions of this section. <br /> 32 be and the same is hereby amended to read as follows: <br /> -8- <br />
