• <br /> 3. Time Period Stay: <br /> The filing of an appeal shall stay the running of the time <br /> periods for subdivision and short subdivision approval as are set <br /> forth in this Ordinance. <br /> 4. Appeal to Court: Any appeals from a decision approving or <br /> disapproving" a subdivision or short subdivision shall be in <br /> accordance with RCW 58.17.180 and shall be filed with the 'court <br /> only after all administrative appeals as set forth herein have <br /> been exhausted. <br /> D. Delegation <br /> Whenever the terms of this Ordinance specifically authorize the <br /> Planning Director or the City Engineer to perform specific acts, the <br /> Planning Director and City Engineer are hereby authorized to delegate <br /> those specific responsibilities to members of their respective staffs. <br /> E. Transition <br /> All applications for preliminary subdivisons and short subdivisions <br /> which are properly filed with the City on or after the 15th day <br /> following the validation date of this Ordinance shall proceed in full <br /> compliance with the requirements of this Ordinance as it presently is <br /> or is hereafter amended and State law. All other subdivisions and <br /> short subdivisions which received preliminary approval prior to the <br /> 15th day following the validation date of this Ordinance shall comply <br /> with the requirements of the prior subdivision code and State law. <br /> F. Effect of Non-Compliance <br /> No building permit or other development permit shall be issued for any <br /> lot or parcel of land divided in violation of Chapter 58.17 R.C.W. or <br /> this Ordinance. All purchases or transfers of property shall comply <br /> with the provisions of Chapter 58.17 R.C.W. and this Ordinance, and <br /> each purchaser or transferee may recover his damages from any person, <br /> firm, corporation or agent selling or transferring land in violation <br /> Chapter 58.17 R.C.W. or this Ordinance, including any amount reasonably <br /> spent as a result of an inability to obtain any development permit and <br /> spent to conform to the requirements of Chapter 58.17 R.C.W. and this <br /> Ordinance as well as the cost of investigation, suit and reasonable <br /> attorney's fees. A purchaser or transferee may, as an alternative to <br /> conforming the property to these requirements, rescind the sale or <br /> transfer and recover the cost of investigation, suit and reasonable <br /> attorney's fees. <br /> -35- <br />
