r <br /> 1 ORDINANCE NO. ///6 Y5' <br /> 2 <br /> AN ORDINANCE amending Section 5 of Ordinance No. 801-80, as <br /> 3 amended by Ordinance No. 914-82. <br /> 4 <br /> 5 THE CITY OF EVERETT DOES ORDAIN: <br /> 6 Section 1: Section 5 of Ordinance No. 801-81 which reads as follows: <br /> 7 <br /> "In addition to the license fee established in Section 4, there is hereby <br /> 8 established a volume fee. For discharging septic waste, there is hereby <br /> established a fee of 1.5¢ per gallon discharged. And for discharging <br /> 9 chemical toilet waste, there is hereby established a fee of 1¢ per gallon <br /> discharged. Septic waste shall include that material taken from cess- <br /> 10 pools, septic tanks and holding tanks. Chemical toilet waste shall include <br /> that material taken from chemical toilets, portable toilets and privies. If <br /> 11 a truck load contains both septic waste and chemical toilet waste, the <br /> licensee shall be charged per the septic waste rate. The charge levied to <br /> 12 the licensee shall be based upon the registered truck volume for each load <br /> discharged unless previously arranged otherwise. <br /> 13 <br /> Furthermore, there shall be a surcharge equal to 25% of the volume fee <br /> 14 for those hauling septic waste from outside the City of Everett and a <br /> surcharge of 25% for those hauling chemical toilet waste from outside the <br /> 15 City of Everett beginning October 1, 1981, through December 31, 1983, <br /> and a 50% surcharge thereafter. <br /> 16 <br /> The volume fee shall be paid to the City within 15 days of mailing the bill <br /> 17 therefor by the City. In the event of non-payment of the volume fee, the <br /> license shall be cancelled. If the licensee questions the amount owing, the <br /> 18 licensee must contact the City prior to the 15th day in which event the <br /> procedure set forth in EMC 14.32.060, 14.32.070, 14.32.080 and 14.32.090 <br /> 19 (as is or is hereafter amended) will be followed. A licensee who appeals <br /> pursuant to the above procedure will not be subject to loss of license <br /> 20 during the appeal proceedings; provided that undisputed amounts are <br /> paid." <br /> 21 <br /> 22 is hereby amended in full to read hereafter as follows: <br /> 23 <br /> "In addition to the license fee established in Section 4, there is hereby <br /> 24 established a volume fee. For discharging septic waste, there is hereby <br /> established a fee of 3.350 per gallon discharged. And for discharging <br /> 25 chemical toilet waste, there is hereby established a fee of 2.25¢ per gallon <br /> discharged. For discharge of leachate from the Cathcart Sanitary <br /> 26 Landfill, there is hereby established a charge of 2.250 per gallon <br /> discharged. After December 31, 1985, any changes in the volume fee <br /> 27 shall be established by resolution of the City Council. Septic waste shall <br /> include that material taken from cesspools, septic tanks and holding <br /> 28 tanks. Chemical toilet waste shall include that material taken from <br /> chemical toilets, portable toilets and privies. If a truck load contains <br /> 29 both septic waste and chemical toilet waste, the licensee shall be charged <br /> per the septic waste rate.
