• • • <br /> 1 ORDINANCE NO. 1 D 3 -c y <br /> 2 <br /> AN ORDINANCE providing for payment by the City of mandatory <br /> 3 employee contributions for all City employees belonging to the <br /> Public Employees' Retirement System or the Law Enforcement <br /> 4 Officers' and Fire Fighters' Retirement System. <br /> 5 <br /> 6 WHEREAS, certain City of Everett employees are members of the mandatory <br /> 7 retirement systems codified in RCW 41.40 (Public Employees' Retirement System) and <br /> 8 RCW 41.26 (Law Enforcement Officers' and Fire Fighters' Retirement System), which <br /> 9 systems provide for mandatory contributions by the covered employees; and <br /> 10 WHEREAS, effective September 1, 1984, Substitute Senate Bill No. 4477 <br /> 11 (Chapter 277, Laws of 1984, 48th Legislature, Regular Session) allows cities to elect to <br /> 12 pay these mandatory contributions on behalf of the employees in the manner provided <br /> 13 for therein; and <br /> 14 WHEREAS, it is in the best interest of the City that the provisions of Substitute <br /> 15 Senate Bill No. 4477 be implemented for employees of the City effective January 1, <br /> 16 1985. <br /> 17 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 18 Section 1: For compensation earned by employees on and after January 1, <br /> 19 1985, the City of Everett elects to implement the employer payment of all member <br /> 20 contributions without exception under RCW 41.26.080(1), 41.26.450, 41.40.330(1), and <br /> 21 41.40.650, as authorized by Section 3 and in accordance with the provisions of <br /> 22 Sections 1 and 2 of Substitute Senate Bill No. 4477, Chapter 277, Laws of 1984, 48th <br /> 23 Legislature of the State of Washington, Regular Session. <br /> 24 Section 2: For purpose of Section 1 of this Ordinance and Sections 1, 2, and 3 <br /> 25 of Substitute Senate Bill No. 4477, Chapter 277, Laws of 1984, 48th Legislature of the <br /> 26 State of Washington, Regular Session, the City Council hereby specifies that the <br /> 27 mandatory contributions under RCW 41.26.080(1), 41.26.450, 41.40.330(1), and <br /> 28 41.40.650, based on compensation earned from and after January 1, 1985, although <br /> 29 designated in those Sections of the Revised Code of Washington as employee contribu- <br /> 30 tions, shall be paid by the City of Everett in lieu of contributions by the employee; and <br /> 31 that such payments shall be designated as employer contributions for purposes of <br /> 32 federal income taxation of the affected employees.
