Any widespread <br /> display of outdoor advertising of this type is deemed to be <br /> 2 inappropriate to the character and sound development of the City, <br /> and it is intended that such advertising be confined to business, <br /> 3 commercial or industrial .property. Accordingly, outdoor <br /> advertising structures, billboards and poster panels (all hereinafter <br /> 4 referred to as billboards) which advertise products or businesses <br /> not connected with the site on which they are located, shall be <br /> 5 permitted uses only on properties which are zoned B-2, C-1, C-2, <br /> and M-1, except that they shall not be located on, or visible from, <br /> 6 the following entryway corridors to the City: <br /> 7 1. Pacific Avenue from the Snohomish River to West Marine <br /> View Drive. <br /> 8 <br /> 2. Hewitt Avenue from the Snohomish River to Terminal <br /> 9 Avenue. <br /> 10 3. Everett Avenue from I-5 to Federal Avenue. <br /> 11 4. West Marine View Drive from Pacific Avenue to East <br /> Marine View Drive and I-5. <br /> 12 <br /> 5. North Broadway from East Marine View Drive to 41st <br /> 13 Street." <br /> 14 <br /> Section 3: That notwithstanding any provisions of Ordinance No. 70-70 and <br /> 15 <br /> Ordinance No. 293-74, any violation of any of the provisions set forth in Sections 1 or 2 <br /> 16 <br /> herein is declared a public nuisance. <br /> 17 <br /> The City is hereby authorized to apply to any court of competent jurisdiction for <br /> 18 <br /> and such court, upon hearing and for cause shown, may grant a preliminary, temporary <br /> 19 <br /> or permanent injunction restraining any person, firm and/or corporation from violating <br /> 20 <br /> any of the provisions of this ordinance, and compelling compliance with the provisions <br /> 21 <br /> thereof. <br /> 22 <br /> Section 4: Non-exclusive Provisions. Penalty and enforcement provisions <br /> 23 <br /> provided in this ordinance shall not be exclusive, and the City may pursue any or all <br /> 24 <br /> remedies or relief deemed appropriate. <br /> 25 <br /> Section 5: That this ordinance and the amendments made to Ordinance No. <br /> 26 <br /> 70-70 will be in effect until June 15, 1985, unless extended by the Everett City Council <br /> 27 <br /> or earlier terminated. The Mayor is hereby authorized to take all steps necessary, <br /> 28 <br /> including legal action, to enforce this interim ordinance. <br /> 29 <br /> Section 6: That if any section, subsection, sentence, clause, phrase or any <br /> 30 <br /> portion of this ordinance is for any reason held to be invalid or unconstitutional by the <br /> 31 <br /> decision of any court of competent jurisdiction, such decision shall not affect the <br /> 32 <br /> -3- <br />
