1 ORDINANCE NO. //is 7 <br /> 2 <br /> AN ORDINANCE establishing policy for segregation of LID assessments <br /> 3 by requiring payment of actual costs of clerical and engineering <br /> time involved and determining that segregation shall not apply to <br /> 4 individual lots in a single family residential subdivision or <br /> individual unit in a single family condominium and amending <br /> 5 Ordinance No. 297-74 (EMC 13.48). <br /> 6 <br /> 7 THE CITY OF EVERETT DOES ORDAIN: <br /> 8 Section 1: Section 2 of Ordinance No. 297-74 (EMC 13.48.260) which reads as <br /> 9 follows: <br /> 10 <br /> All segregations of a parcel of land in a confirmed LID assessment roll <br /> 11 shall not be considered until the following requirements have been met: <br /> 12 A. A written request for segregation of a parcel of land in an LID has <br /> been received by the City Engineer which shall be accompanied by <br /> 13 satisfactory evidence of ownership of said parcel of land as the <br /> City Attorney may direct; and <br /> 14 <br /> B. A forty dollar fee for each new description that will be entered on <br /> 15 the supplemental LID roll has been received by the City Treasurer; <br /> 16 C. Assessment installment payments are current on the parcel of land <br /> to be segregated except when otherwise directed by City Council <br /> 17 in a special provision written into the resolution segregating the <br /> parcel of land. <br /> 18 <br /> 19 is hereby amended as follows: <br /> 20 <br /> All segregations of a parcel of land in a confirmed LID assessment roll <br /> 21 shall not be considered until the following requirements have been met: <br /> 22 A. A written request for segregation of a parcel of land in an LID has <br /> been received by the City Engineer which shall be accompanied by <br /> 23 satisfactory evidence of ownership of said parcel of land as the <br /> City Attorney may direct; and <br /> 24 <br /> B. A forty dollar ($40) fee for each new description that will be <br /> 25 entered on the supplemental LID roll has been received by the City <br /> 26 Treasurer; <br /> 27 C. Assessment installment payments are current on the parcel of land <br /> to be segregated except when otherwise directed by City Council <br /> in a special provision written into the resolution segregating the <br /> 28 parcel of land; <br /> 29 D. In addition to the said forty dollar ($40) fee for each description, <br /> 30 actual costs, including salary related benefits, of Public Works <br /> Department engineering and clerical time to process said segrega- <br /> tions shall be paid prior to approval of the segregation by City <br /> 31 Council. A deposit of estimated costs as determined by the City <br /> Treasurer toward said actual cost shall be required to be paid prior <br /> 32 to commencing segregation proceedings. <br />
