• <br /> 1 ORDINANCE NO. /06$-i(S/ <br /> 2 <br /> AN ORDINANCE amending Section 1 of Ordinance No. 993-83 (EMC <br /> 3 46.10.010) authorizing impoundment of vehicles on private property <br /> for unauthorized parking in disabled stalls. <br /> 4 <br /> 5 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: Section 1 of Ordinance No. 993-83 (EMC 46.10.010) which reads as <br /> 7 <br /> follows: <br /> 8 <br /> 9 Officers authorized to remove certain vehicles. <br /> 10 Any police officer may take custody of a vehicle and provide for its <br /> prompt removal to a place of safety under any of the following <br /> 11 circumstances: <br /> 12 1. Whenever any police officer finds a vehicle standing upon the <br /> roadway in violation of any of the provisions of RCW 46.61.560, the <br /> 13 officer is hereby authorized to provide for the removal of the <br /> vehicle or require the driver or other person in charge of the <br /> 14 vehicle to move the vehicle to a position off the roadway. <br /> 15 2. Whenever any police officer finds a vehicle unattended upon any <br /> highway where the vehicle constitutes an obstruction to traffic or <br /> 16 jeopardizes public safety. <br /> 17 3. Whenever a police officer finds an unattended vehicle at the scene <br /> of an accident or when the driver of any vehicle involved in an <br /> 18 accident is physically or mentally incapable, or too intoxicated, to <br /> decide upon steps to be taken to protect his or her property. <br /> 19 <br /> 4. Whenever the driver of a vehicle is arrested and taken into custody <br /> 20 by a police officer, and the driver, because of intoxication or <br /> otherwise, is mentally incapable of deciding upon steps to be taken <br /> 21 to safeguard his or her property. <br /> 22 5. Whenever a police officer discovers a vehicle which he determines <br /> to be a stolen vehicle. <br /> 23 <br /> 6. Whenever any police officer finds a vehicle standing or parked in a <br /> 24 designated tow-away zone. <br /> 25 7. Whenever any police officer finds a vehicle immobilized for <br /> twenty-four (24) hours or longer as the result of the vehicle having <br /> 26 been declared a public nuisance pursuant to the City's Parking <br /> Ordinance. <br /> 27 <br /> 8. Whenever a vehicle without a special license plate, card, or decal <br /> 28 indicating that the vehicle is being used to transport a disabled <br /> person under RCW 46.16.380 is parked in a stall or space marked in <br /> 29 accordance with requirements of the City's Parking Ordinance on <br /> public property. <br /> 30 <br /> 9. Whenever any police officer finds a vehicle standing or parked in a <br /> 31 fire lane or within fifteen (15) feet of any fire hydrant whether on <br /> public or private property. <br /> 32 <br />
