• 1 ORDINANCE NO. /06$-i(S/ 2 AN ORDINANCE amending Section 1 of Ordinance No. 993-83 (EMC 3 46.10.010) authorizing impoundment of vehicles on private property for unauthorized parking in disabled stalls. 4 5 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 6 Section 1: Section 1 of Ordinance No. 993-83 (EMC 46.10.010) which reads as 7 follows: 8 9 Officers authorized to remove certain vehicles. 10 Any police officer may take custody of a vehicle and provide for its prompt removal to a place of safety under any of the following 11 circumstances: 12 1. Whenever any police officer finds a vehicle standing upon the roadway in violation of any of the provisions of RCW 46.61.560, the 13 officer is hereby authorized to provide for the removal of the vehicle or require the driver or other person in charge of the 14 vehicle to move the vehicle to a position off the roadway. 15 2. Whenever any police officer finds a vehicle unattended upon any highway where the vehicle constitutes an obstruction to traffic or 16 jeopardizes public safety. 17 3. Whenever a police officer finds an unattended vehicle at the scene of an accident or when the driver of any vehicle involved in an 18 accident is physically or mentally incapable, or too intoxicated, to decide upon steps to be taken to protect his or her property. 19 4. Whenever the driver of a vehicle is arrested and taken into custody 20 by a police officer, and the driver, because of intoxication or otherwise, is mentally incapable of deciding upon steps to be taken 21 to safeguard his or her property. 22 5. Whenever a police officer discovers a vehicle which he determines to be a stolen vehicle. 23 6. Whenever any police officer finds a vehicle standing or parked in a 24 designated tow-away zone. 25 7. Whenever any police officer finds a vehicle immobilized for twenty-four (24) hours or longer as the result of the vehicle having 26 been declared a public nuisance pursuant to the City's Parking Ordinance. 27 8. Whenever a vehicle without a special license plate, card, or decal 28 indicating that the vehicle is being used to transport a disabled person under RCW 46.16.380 is parked in a stall or space marked in 29 accordance with requirements of the City's Parking Ordinance on public property. 30 9. Whenever any police officer finds a vehicle standing or parked in a 31 fire lane or within fifteen (15) feet of any fire hydrant whether on public or private property. 32
