• <br /> • <br /> Section 4: That as a condition of this ordinance, an agreement by and between the <br /> petitioner/proponent of the above described vacation and the owner of the property <br /> described as follows: <br /> That portion of Section 6, Township 28 North, Range 5 East, W.M.; beginning at <br /> the most Northerly corner of Lot 23, Plat of Fairview Heights, Division 2, <br /> according to the plat thereof, recorded in Volume 12 of Plats, page 60, records of <br /> Snohomish County, Washington; thence Southwesterly along the Westerly lot line <br /> of said lot of said plat, and continuing along thoe lot line of Lot 22, of said plat a <br /> distance of 368.89 feet; thence angle right 82 57'40" and proceed a distance of <br /> 100 feet; thence angle right 90°00'00" and proceed a distance of 30 feet; thence <br /> angle right 23°21'45" and proceed a distance of 366.13 feet to the point of <br /> beginning, <br /> shall be made to provide for future access to the above described property. <br /> Section 5: That all monies derived from the sale of the above described right-of- <br /> way vacation shall be deposited in the "Real Property Acquisition Fund". <br /> Section 6: Upon the payment of the required compensation and fulfillment of <br /> each and every condition recited herein, this ordinance shall be recorded with the <br /> Snohomish County Auditor. <br /> a - <br /> WILLIAM E.
