1 be and the same is hereby amended to read as follows: <br /> 2 <br /> TAX CONSTITUTES DEBT: Any license fee or tax due and unpaid under <br /> 3 this ordinance, and all penalties thereon, shall constitute a debt to <br /> Everett, a municipal corporation, and may be collected by court <br /> 4 proceedings in the same manner as any other debt in like amount, which <br /> remedy shall be in addition to all other existing remedies. The right of <br /> 5 recovery against the City of Everett because of overpayment of tax by <br /> any taxpayer shall be outlawed after the expiration of three (3) years <br /> 6 after which time the taxpayer shall have no right of recovery against the <br /> City of Everett. The City of Everett is acting in its sovereign capacity and <br /> 7 is not subject to any statute of limitations when collecting from the <br /> taxpayer for any tax provided hereunder. <br /> 8 <br /> 9 Section 3: SEVERABILITY. If any provision of this ordinance shall be <br /> 10 declared unconstitutional or invalid by any court of competent jurisdiction, it shall be <br /> 11 conclusively presumed that this ordinance would have been enacted without the <br /> 12 provision so held unconstitutional or invalid and the remainder of this ordinance shall <br /> 13 not be affected as a result of said part being held unconstitutional or invalid. <br /> 14 <br /> 15 day-ef , 198 -- <br /> 16 <br /> 17 tlO�t e/ <br /> 18 ILLIAM E.
