• <br /> 1 G. "Secondhand property" means any item of personal property offered for <br /> 2 sale which is not new, including metals in any form, except postage stamps, coins that <br /> 3 are legal tender, boullion in the form of fabricated hallmarked bars, and clothing of a <br /> 4 resale value of seventy-five dollars or less, except furs. <br /> 5 H. "Transaction" means a pledge, purchase, or consignment by a pawnbroker <br /> 6 or a secondhand dealer from a member of the general public. <br /> 7 Section 2: LICENSE REQUIREMENTS. <br /> 8 A. License Required: Except as provided otherwise in Section 3 herein, no <br /> 9 person shall engage in the business of dealing in metal or nonmetal junk; secondhand <br /> 10 property, or engage in the business of a pawnbroker in the City of Everett, without first <br /> 11 obtaining a license therefor. <br /> 12 B. Requirements in Addition to General Provisions: In addition to the <br /> 13 general requirements, there is the additional requirement that the applicant(s) or <br /> 14 manager(s) or owner(s) of the applicant have not been convicted of a crime of moral <br /> 15 turpitude or intent to defraud within ten (10) years from the date of application, and, <br /> 16 furthermore, has not within ten (10) years from the date of application been released <br /> 17 from a penal institution or from active supervision or parole as a result of the <br /> 18 conviction of any of the aforementioned crimes. <br /> 19 C. Fixed Place of Business: No person may operate as a pawnbroker or <br /> 20 secondhand dealer unless the person maintains a fixed place of business in the City of <br /> 21 Everett. No person shall engage in any such business in more than one place, or <br /> 22 maintain more than one shop or store for the same, by virtue of one license. <br /> 23 D. The annual license fee for pawnbrokers shall be the sum of Two Hundred <br /> 24 Fifty Dollars ($250). The annual license fee for secondhand dealers shall be the sum of <br /> 25 Fifty Dollars ($50). <br /> 26 Section 3: EXCEPTIONS. Except as provided in Section 12 herein, the <br /> 27 provisions of this ordinance do not apply to transactions conducted by the following: <br /> 28 1. Motor vehicle dealers licensed under Chapter 46.70 RCW; <br /> 29 2. Motor vehicle wreckers or hulk haulers licensed under Chapter 46.79 or <br /> 30 46.80 RCW; <br /> 31 3. Persons giving an allowance for the trade-in or exchange of secondhand <br /> 32 property on the purchase of other merchandise of the same kind of greater value; and <br /> -2- <br />
