1 buying the same, and such books of account shall at all times be kept open to the <br /> 2 inspection of the Police Department of the City of Everett; provided, that dealers in <br /> 3 new motor vehicles who take used motor vehicles in exchange shall not be required to <br /> 4 keep such records of sales. <br /> 5 Section 13: PENALTIES. The violation of any provision of this Ordinance <br /> 6 shall constitute a criminal offense and shall be punishable by a fine of $5000 and/or 1 <br /> 7 year in jail. It shall also be a violation of this Ordinance for: <br /> 8 1. Any person to remove, alter, or obliterate any manufacturer's make, <br /> 9 model, or serial number, personal identification number, or identifying marks engraved <br /> 10 or etched upon an item of personal property that was purchased, consigned, or received <br /> 11 in pledge; <br /> 12 2. Any person to knowingly make, cause, or allow to be made any false entry <br /> 13 or misstatement of any material matter in any book, record, or writing required to be <br /> 14 kept under this ordinance; <br /> 15 3. Any pawnbroker or secondhand dealer to receive any property from any <br /> 16 person under the age of eighteen years, any person under the influence of intoxicating <br /> 17 liquor or drugs, or any person known to the pawnbroker or secondhand dealer as having <br /> 18 been convicted of burglary, robbery, theft, or possession of or receiving stolen property <br /> 19 within the past ten years whether the person is acting in his or her own behalf or as the <br /> 20 agent of another; or <br /> 21 4. Any person to violate knowingly any other provision of this ordinance, or <br /> 22 amendments thereto. <br /> 23 Section 14: REPEALER. Chapter 8 of Ordinance No. 295-74 (EMC 5.32) is <br /> 24 hereby repealed in its entirety. <br /> 25 Section 15: VALIDITY. If any provision of this ordinance or its application <br /> 26 to any person or circumstance is held invalid, the remainder of the ordinance or the <br /> 27 application of the provision to other persons or circumstances is not affected. <br /> 28 <br /> 29 WILLIAM E.
