WHEREAS, the public health, safety and welfare would be best served by <br /> .nticipating the impact of such development and imposing certain mutually <br /> .greed upon standards, conditions and requirements which shall be documented <br /> erein and hereafter considered to be an integral part of the zoning <br /> estrictions applicable to the property; <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. PERMITTED USES <br /> A. Parcels A, B & C shall be zoned B-2. Community Shopping Zone. <br /> B. Permitted uses shall be limited to the following uses permitted <br /> in the B-2 Community Shopping Zone; offices, medical or dental <br /> clinics; medical or dental laboratories, travel agencies or <br /> dance, music, or art studios in which no retail sales occur on <br /> the premises. <br /> C. The height of all buildings will be restricted to a maximum of 35 <br /> feet. <br /> D. The type and density of residential units will be restricted to <br /> that of the R-2 zone. <br /> E. The property owned by MTB Investments, Parcel A, which is shown <br /> on the site development plan (Exhibit 5) , which is attached <br /> hereto and incorporated by reference, shall be developed as <br /> indicated by that plan. <br /> CONCOMITANT AGREEMENT - 2 <br />
