• <br /> • <br /> I required by Chapter 82.29A RCW. Applicants shall pay to the City which shall remit to <br /> 2 the State Department of Revenue the aforesaid leasehold excise tax in accordance with <br /> 3 Chapter 82.29A RCW. <br /> 4 Section 7: Evaluation. The permit fee schedule set forth in Section 3 shall <br /> 5 be evaluated biennially (commencing three years after the effective date of this <br /> 6 ordinance) by the City's Real Property Manager who shall make a biennial report to <br /> 7 City Council. <br /> 8 Section 8: Real Property Acquisition Fund. All monies derived from the <br /> 9 permit fees for the temporary use of City property shall be deposited in the Real <br /> 10 Property Acquisition Fund. <br /> 11 Section 9: Application Fee. A non-refundable application fee in an amount <br /> 12 determined by the Director of Public Works shall be paid at the time application is <br /> 13 made for a permit for the temporary use of City right-of-way. <br /> 14 Section 10: Restoration. In the event a permit for the temporary use of City <br /> 15 right-of-way is terminated for any reason, the permittee shall remove all property not <br /> 16 owned by the City from the above-described property and shall restore the property to <br /> 17 the satisfaction of the City. Such removal and restoration shall be completed <br /> 18 immediately upon termination of the permit. In the event the applicant shall fail to <br /> 19 remove property and restore the location to the satisfaction of the City as is required, <br /> 20 at the option of the City, the City shall be entitled to remove the property in which <br /> 21 case the property removed shall become the property of the City. Any expense <br /> 22 incurred by the City in removing the property and restoring the location shall be paid by <br /> 23 the applicant immediately upon billing of the costs thereof by the City. This right is in <br /> 24 addition to any other right the City may have at law or in equity. <br /> 25 Section 11: Suspension, Revocation and Termination. The Director of Public <br /> 26 Works or his designee is authorized to suspend or revoke any permit issued herein <br /> 27 whenever the permit is issued in error or on the basis of incorrect information supplied, • <br /> 28 or in violation of any ordinance or regulation of the City, or when the permittee fails to <br /> 29 pay the permit fee. <br /> 30 Any permit issued hereunder is terminable at the will of the City upon thirty (30) <br /> 31 days notice to the permittee.
