• <br /> 1 ORDINANCE NO. /0-YC erg <br /> 2 <br /> 3 AN ORDINANCE establishing a surcharge to provide water service to <br /> the Smith Island area. <br /> 4 <br /> 5 WHEREAS, the City Council of the City of Everett has annexed certain areas of <br /> 6 Smith Island northerly of the City of Everett pursuant to Ordinance Nos. 942-83 and <br /> 7 964-83; and <br /> 8 WHEREAS, the water service in the Smith Island area is now provided by a <br /> 9 private utility, the Smith Island Water Users Association, Inc.; and <br /> 10 WHEREAS, said utility has requested the City of Everett to take over operation <br /> 11 of the utility and to accept certain easements upon which water facilities are located <br /> 12 for the provision of water service to customers in the Smith Island area; and <br /> 13 WHEREAS, City Council finds that due to the deteriorated condition of the <br /> 14 water distribution facilities in the Smith Island area, the cost of water service in the <br /> 15 area is substantially greater than other areas of the City of Everett; and <br /> 16 WHEREAS, the City Council finds that the additional cost of service is <br /> 17 approximately $.32 per 100 cubic feet to provide water distribution service in the Smith <br /> 18 Island area; <br /> 19 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 20 Section 1: The City of Everett hereby accepts all easements and quit claim <br /> 21 deeds submitted to the City of Everett by the Smith Island Water Users Association <br /> 22 and, in addition, all water mains, pipes, valves, hydrants and other water facilities <br /> 23 included within such easements. <br /> 24 Section 2: In addition, the Mayor is authorized to take such action as <br /> 25 necessary to collect delinquent water accounts of the Smith Island Water Users <br /> 26 Associations, Inc. in accordance with the applicable charges of said Association. <br /> 27 Section 3: As a condition of acceptance of Smith Island Water Users Associa- <br /> 28 tion, Inc.'s property and easements and further as a condition of service to customers in <br /> 29 the Smith Island area, there is hereby established a surcharge of $.32 per 100 cubic feet <br /> 30 applicable to all metered services in the Smith Island area said area being that <br /> 31 described in the annexation Ordinance Nos. 942-83 and 964-83.
