• <br /> • <br /> 1 ORDINANCE NO. /Q. 1/-p'Sf <br /> 2 <br /> AN ORDINANCE providing for the regulation of sale, possession and use <br /> 3 of fireworks within the City limits and repealing Ordinance <br /> No's. 3882, 308-74 and 353-75 (EMC 16.60). <br /> 4 <br /> 5 <br /> WHEREAS, the Washington legislature has amended the Washington State <br /> 6 <br /> Fireworks Law in 1982 and again in 1984; and <br /> 8 WHEREAS, the current fireworks ordinance does not accurately reflect the <br /> changes in State law and should be amended to do so; <br /> 9 <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 10 <br /> Section 1: DEFINITION. For the purpose of this Chapter, the following <br /> 11 <br /> 12 words shall mean: <br /> 13 A. "Fireworks" means any composition or device, in a finished state contain- <br /> 14 ing any combustible or explosive substance for the purpose of producing a visible or <br /> 15 audible effect by combustion, explosion, defalgration, or detonation, and classified as <br /> 16 common or special fireworks. <br /> 17 B. "Special Fireworks" means any fireworks designed primarily for exhibition <br /> 18 display by producing visible or audible effects. The term includes: <br /> 19 1. fireworks commonly known as skyrockets, missile type <br /> 20 rockets, firecrackers, salutes, and chasers; and <br /> 21 2. fireworks not classified as common fireworks. <br /> 22 C. "Common Fireworks" means any fireworks designed primarily to produce <br /> 23 visual or audible effect by combustion. <br /> 24 <br /> 25 1. The term includes: <br /> 26 a. ground and hand held sparkling devices, including <br /> items commonly known as dipped sticks, sparklers, <br /> 27 cylindrical fountains, cone fountains, illuminating <br /> torches, wheels, ground spinners, and flitter <br /> 28 sparklers; <br /> 29 b. smoke devices; <br /> 30 c. helicopters containing not more than 20 grams of <br /> pyrotechnic composition, aerials, spinners, roman <br /> 31 candles, mines, and shells; <br /> 32 <br />
