Unless otherwise amended by City <br /> Council, this ordinance shall be null and void if the abutting property owners fail to <br /> exercise this vacation within ninety (90) days following passage of this ordinance. <br /> Section 4: That the City of Everett hereby retains an easement to construct, <br /> reconstruct, operate, maintain, repair, and replace all utilities under, over, and across <br /> the following described portions of said right-of-way: <br /> PINE STREET EASEMENT <br /> An easement of 30.00 feet in width being 10.00 feet Easterly of a <br /> centerline and 20.00 feet Westerly of a centerline for the <br /> purpose of maintaining a sanitary sewer over, under, and across a <br /> portion of Pine Street, situated in the City of Everett, Snohomish <br /> County, State of Washington, the centerline of said easement <br /> being described as follows: <br /> Commencing at the Northeast corner of the Plat of Baker <br /> Heights, according to the plat thereof recorded in Volume 14 of <br /> Plats, at page 111, records of said county; thence South <br /> 00°00'49" East along the East boundary of said Plat of Baker <br /> Heights f r 241.56 feet to the true point of beginning; thence <br /> South 0931'38" East for 237.75 feet; thence South 00°00'49" <br /> East for 381.31 feet to the begjnning of a curve to the left whose <br /> radius center bears North 89 59'11" East a distance of 100.00 <br /> feet; thence along the arc of said curve for 85.59 feet and <br /> consuming a central angle of 49 02'18" to a point on the North <br /> margin of 14th Street projected, said point also being the <br /> termination of said centerline. <br /> 13TH STREET EASEMENT <br /> An easement of 15.00 feet in width being 7.50 feet on each side <br /> of a centerline for the purpose of maintaining a storm line over, <br /> under, and across a portion of 13th Street, situated in the City of <br /> Everett, Snohomish County, State of Washington, the centerline <br /> of said easement being described as follows: <br /> Commencing at the Southwest corner of Lot 17, Block 231 of the <br /> Plat of Everett Division "T", according to the plat thereof <br /> recorded in Volume 7 of Plats, at page 30, records of said county; <br /> thence South 00°00'49" East along the east line of said Block 231 <br /> projected for 25.37 feet; thence North 87°10'12" West for 40.76 <br /> feet to the true point of beginning; thence South 87°10'12" East <br /> for 164.91 feet to a point on the Easterly projection of an alley <br /> on the East line of said Lot 17, Block 231, point also being the <br /> termination of said centerline. <br /> The City of Everett further retains the right to grant to public and private <br /> utilities the right to construct, reconstruct, operate, maintain, repair, and replace <br /> existing or proposed utility lines including, but not limited to, telephone, gas, and <br /> electrical under, over, and across the property above described, together with the <br /> following described parcel: <br /> That portion of Pine Street lying South of, parallel with, adjacent <br /> to, and contiguous with the South margin of 12th Street, more <br /> particularly described as follows: <br />
