1 ORDINANCE NO. / O- <br /> 2 <br /> AN ORDINANCE providing for an advisory ballot on the location of a <br /> 3 Navy base in the City of Everett. <br /> 4 <br /> 5 WHEREAS, on April 4, 1984, an initiative petition was presented to the City <br /> 6 Council proposing an ordinance establishing an advisory election on the issue: "Do the <br /> 7 citizens of Everett desire the U. S. Navy to establish a battle group in the City of <br /> 8 Everett?"; and <br /> 9 WHEREAS, the ordinance proposed by the initiative petition also prohibits the <br /> 10 City of Everett from taking certain actions to effect the establishment of a Navy <br /> 11 battle group in the City of Everett before the results of the election to be held are <br /> 12 known; and <br /> 13 WHEREAS, said prohibition prevents the City Council and other City officials <br /> 14 from exercising authority delegated to them directly by the State legislature and, as <br /> 15 such, is outside the scope of the initiative power; and <br /> 16 WHEREAS, said prohibition may unconstitutionally interfere with the Navy's <br /> 17 home port location process; and <br /> 18 WHEREAS, the City Council desires to provide citizens of Everett an <br /> 19 opportunity to express their opinion on the location of a Navy base in the City of <br /> 20 Everett, but the City Council has been advised that an initiative ordinance providing a <br /> 21 moratorium on Council actions affecting the establishment of a Navy battle group in <br /> 22 Everett would be invalid and unconstitutional; <br /> 23 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 24 Section 1: That an election shall be held to seek the advice of the qualified <br /> 25 electors of the City of Everett on the following measure: <br /> 26 <br /> 27 CITY OF EVERETT <br /> ADVISORY BALLOT <br /> 28 NAVY HOME PORT <br /> Do the citizens of Everett desire the U. S. Navy to establish a home port <br /> 29 for a Navy battle group in Everett? <br /> 30 <br /> 31 YES NO <br /> 32 <br />
