located south of 100th Street between Interstate 5 and 19th Avenue S.E. (SR <br /> 527), Everett, Snohomish County, Washington, the legal description of which is <br /> attached hereto as Exhibit C (Parcel C) and incorporated herein by this <br /> reference; and <br /> WHEREAS, such zoning and development is adjacent to the I-5 corridor <br /> and 19th Avenue S.E. and will provide for a major commercial center and high <br /> density residential uses abutting these two north/south entry corridors to the <br /> City of Everett; and <br /> WHEREAS, the public health, safety, and welfare would be best served by <br /> anticipating the impact of such development and imposing certain mutually <br /> agreed upon standards, conditions and requirements which shall be documented <br /> herein and hereafter considered to be an integralpart of the zoning <br /> restrictions applicable to the property; and <br /> WHEREAS, the Owners have agreed to develop the aforementioned property <br /> per the 19th Avenue S.E. Comprehensive Plan (The Plan), which is incorporated <br /> herein by reference in consideration of the City considering designating the <br /> property C-2 and the Owners further agree as part of said consideration that <br /> should the City zone the property C-2, to lay out, develop, and maintain the <br /> property as hereinafter set forth; <br /> NOW THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> 1. PERMITTED USES <br /> A. Parcels A, B & C shall be zoned C-2 Heavy Commercial Light <br /> Industrial Zone. <br /> B. Prohibited C-2 uses shall. include: <br /> New and used car lots <br /> Auto wrecking yards <br /> Grain elevators <br /> Junk yards <br /> Adult Entertainment Uses as defined in Ord. No. 3572 as amended <br /> by Ord. 1025-84 and any subsequent amendments. <br /> CONCOMITANT AGREEMENT - 2 <br />
