• <br /> CONCOMITANT AGREEMENT TO ZONING ORDINANCE NO. ,cif-. SI <br /> Reference Rezone File #1-84, D & D Investment <br /> Casino Road Mini Storage <br /> THIS AGREEMENT made and entered into this 7 day of /I R, , <br /> 1984 by and between the City of Everett, a municipal corporation under the <br /> laws of the State of Washington, hereinafter called the "City" , and D & D <br /> Investment, hereinafter called "Owner". <br /> WITNESSETH: <br /> WHEREAS, the Owner has made application to the City to establish <br /> zoning on the parcel of property described in the Ordinance which is <br /> marked Exhibit "A" , attached hereto and incorporated herein by reference; <br /> and <br /> WHEREAS, it is believed that the zoning of said area to permit <br /> Owner's development will be in he public health, safety and welfare of the <br /> citizens of Everett and, further , that the public health, safety and <br /> welfare of the citizens of Everett would best be served by anticipating <br /> the impact of such development and imposing certain mutually agreed upon <br /> standards, conditions and requirements; and <br /> WHEREAS, the Owner has agreed to develop the aforementioned <br /> property as mini storage facility in consideration of the City considering <br /> designating the property C-1 and the owner agrees as part of said <br /> consideration that should the City zone the property C-1 to lay out, <br /> develop and maintain mini—storage facility as hereinafter set forth; <br /> NOW, THEREFORE, it is mutually agreed that the zone changes are <br /> granted subject to the following conditions: <br /> Section 1: Planning Department Requirements <br /> a. The Applicant shall develop the site consistent with the <br /> site plan submitted. (Exhibit #3) <br /> b. Building elevations shall be as shown on site plan. (Exhibit <br /> #3) <br /> c. Colors and materials used shall be consistent with Casino <br /> Square Shopping Center. <br /> d. Mini storage buildings shall not contain any advertising on <br /> structure walls nor shall they ever be painted any bright <br /> vibrant colors to attract attention. <br /> e. A detailed landscaping plan focusing on the following items <br /> shall be submitted to and approved by the Planning Department: <br /> 1. Specific plant type used. <br /> 2. West property line shall consist of a greenbelt of five <br /> (5) feet in width protective screening not less than <br /> 72" in height with sufficient planting to create a <br /> sight obscuring barrier (19.42.030(B) E.M.C.) . <br /> 3. Rest of the proposed planting area shall be continuous <br /> live ground cover over at least 75% of planting area <br /> with evergreen shrubs, trees or other vertical growth <br /> at least 36" in height, to number at least six (6) feet <br /> for each 100 square feet of required landscape area. <br /> Planting shall be sufficient to provide full coverage <br /> within three years of initial planting.
