1. Steve M. Hale shall abate all violations of IRC 105.1 and IRC 113.1; IRC 114.3 and EMC §19.39.150(C)on the property located at 420 47th Street.SE,Everett,Washington. 2. Steve M. Hale shall be fined$1500 for the aforementioned violations. $1000 of this fine will be suspended until February 1,2010 if the respondent complies with the following conditions: a. The respondent must comply with the Everett Land Use Code and obtain any land use approvals necessary under EMC Title 19, Zoning Code. b. The respondent must obtain any construction permits required pursuant to EMC Title 16. c. That portion of the residential structure constructed without permit must be vacated and remain vacated until a legal and valid Certificate of Occupancy is obtained. d. All necessary construction work referenced in the above mentioned permits must be completed, and inspected and approved by the City and a Certificate of Occupancy obtained. e. The work must be completed and the Certificate of Occupancy obtained within six months. f. If the respondent is unable to comply with subsections a-e of this Section 2 that portion of the building that was built without permits must be demolished and inspected by the City. A demolition permit is required prior to demolition. g. Subsections a-f of this Section 3 must be completed by February 1,2010. Compliance with these subsections in no way relieves the respondent of his obligation to comply with any other codes or regulations prior to receiving the certificate of occupancy. 3. If the respondent fails to comply with Section 2 of this Order,he will immediately owe the City the suspended portion of the fine. If the respondent complies with Section 2 of this Order the suspended portion of the fine shall be waived without further action of the Examiner. 4. Steve M. Hale shall not violate any ordinance set forth in EMC §1.20.020 or any ordinance or regulation that identifies the enforcement procedure described in Chapter 1.20 EMC as the enforcement procedure for said regulations or ordinance, for the next twelve(12)months. 5. Steve M. Hale and shall pay the unsuspended portion of the fine imposed in Section 2 of this Order($500.00)no later than August 14,2009. Payment shall be made to the City of Everett Treasurer at 2930 Wetmore Suite 100,Everett Washington,98201. If payment is not made on or before August 14,2009,collection action will be taken,which may include assigning the debt to a collection agency pursuant to EMC 1.20.050(D). 6. This written Order shall be controlling over any conflicts with oral Orders issued at the Public Hearing. 7. If the owner fails to abate the identified violations as directed by this Order,the City of Everett is authorized to undertake and complete the abatement in conformance with the provisions of the Everett Municipal Code, Chapter 1.20, at the full expense of the owner and the City may act without further order or direction of the Violations Hearing Examiner.
