a required setback area." The "'rear setback' means the required minimum distance between the <br /> rear lot line and any structure,building or use." EMC § 19.04.020. <br /> 4. Pursuant to EMC § 1.20.020 (A)(19) and EMC § 16.01.040(0), the Violations Hearing Examiner <br /> has jurisdiction over EMC these matters and these parties. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law read into the record at the October 8, 2009, <br /> hearing of the above matter,the following Order is issued: <br /> 1. Steve M. Hale shall abate all violations of IRC 105.1 and IRC 113.1; IRC 114.3 and EMC <br /> §19.39.150(C) on the property located at 420 47th Street SE, Everett,Washington. <br /> 2. Steve M. Hale shall be fined$1500 for the aforementioned violations. $1000 of this fine will be <br /> suspended until February 1, 2010 if the respondent complies with the following conditions: <br /> a. The respondent must comply with the Everett Land Use Code and obtain any land use <br /> approvals necessary under EMC Title 19, Zoning Code. <br /> b. The respondent must obtain any construction permits required pursuant to EMC Title <br /> 16. <br /> c. That portion of the residential structure constructed without permit must be vacated <br /> and remain vacated until a legal and valid Certificate of Occupancy is obtained. <br /> d. All necessary construction work referenced in the above mentioned permits must be <br /> completed, and inspected and approved by the City and a Certificate of Occupancy <br /> obtained. <br /> e. The work must be completed and the Certificate of Occupancy obtained within six <br /> months. <br /> f. If the respondent is unable to comply with subsections a-e of this Section 2 that portion <br /> of the building that was built without permits must be demolished and inspected by the <br /> City. A demolition permit is required prior to demolition. <br /> g. Subsections a-f of this Section 2 must be completed by February 1, 2010. Compliance <br /> with these subsections in no way relieves the respondent of his obligation to comply with <br /> any other codes or regulations prior to receiving the certificate of occupancy. <br /> 3. If the respondent fails to comply with Section 2 of this Order,he will immediately owe the City <br /> the suspended portion of the fine. If the respondent complies with Section 2 of this Order the <br /> suspended portion of the fine shall be waived without further action of the Examiner. <br /> 4. Steve M. Hale shall not violate any ordinance set forth in EMC §1.20.020 or any ordinance or <br /> regulation that identifies the enforcement procedure described in Chapter 1.20 EMC as the <br /> enforcement procedure for said regulations or ordinance, for the next twelve(12)months. <br /> 4 �� <br />
