Notwithstanding the minimum periods of affordability required by the HOME <br /> regulations, the term of this loan is determined by this Section I, Subsection G. Upon <br /> completion of the HOME Compliance Period, the HOME-Assisted Units shall <br /> thereafter be City-Assisted Units, and shall comply with the requirements of City- <br /> Assisted Units ("City-Assisted Units"), for the remaining term of the loan, the End <br /> Date of the Agreement, as specified in the Use Restriction Covenant Agreement. <br /> 2. City Compliance Period: For City-Assisted Units, as defined herein and in Exhibit A, <br /> the commitment to serve the target population per the terms of this Agreement will <br /> commence on the Effective Date of this Agreement and remain in effect through the <br /> term of this Loan Agreement, which shall expire on the End Date. <br /> Throughout the term of this Agreement, the City-Assisted Units shall remain affordable <br /> until the End Date, as specified in the Use Restriction Covenant Agreement. <br /> 3. This Loan Agreement may be terminated by the City as provided in Section VI-B <br /> hereof. <br /> H. Agency Operations <br /> The Agency shall provide or cause to be provided administrative, fiscal, and management <br /> services; employ staff; and purchase, rent, and use supplies and materials as needed to <br /> operate, maintain, and protect the Project in accordance with this Loan Agreement, the <br /> HOME Program statutes and the HOME Regulations. This shall include, but not be limited <br /> to, compliance with the grounds and procedures governing grievance hearings as set forth <br /> in the HOME Regulations. In addition, grievance hearings, conferences, notices, and <br /> summaries pursuant to this Loan Agreement shall be in English or in the language of the <br /> majority of residents. <br /> I. Obligations Following Termination <br /> Following expiration or termination of this Loan Agreement, the Agency's obligations to <br /> the City shall remain in full force and effect until all closeout requirements are completed. <br /> The HOME-Assisted Units shall remain in compliance with all HOME requirements until <br /> the completion of the HOME Compliance Period. Upon completion of the HOME <br /> Compliance Period, all units in the project shall remain in compliance with the <br /> requirements for City-Assisted Units through the duration of the term of this Agreement. <br /> Closeout requirements comprise all actions required to demonstrate to the City's <br /> satisfaction that all terms and conditions of the Agreement have been fulfilled, including, <br /> but not limited to, disposition of tangible property and provision of reports and data. <br /> J. Term for Expenditure of HOME Funds and Project Completion <br /> The Agency shall fully disburse the HOME funds provided under this Loan Agreement for <br /> the development of the Project in accordance with the terms hereof according to the <br /> following schedule: All HOME funds must be expended and the Project completed within <br /> four (4) years from the Effective Date of this Loan Agreement.
