gy, a - /O ORDINANCE NO. /Cfi' 7- . AN ORDINANCE providing for the vacation of a portion of Spokane Drive lying immediately north of its confluence with Beverly Boulevard and Broadway. WHEREAS, the City Council of the City of Everett did, by Resolution 2373, duly adopt and fix the 27th day of January, 1984, at 8:30 a.m., as the date for public hearing; and WHEREAS, due and legal notice of the time and place of said hearing and determination of said resolution has been given by the City Clerk in the manner prescribed by law; and WHEREAS, at the time and place fixed for hearing, favorable statements and objections to the vacating of the herein described street were heard and discussed; and WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the street which is vacated; and WHEREAS, the City Council finds that it would not vacate the street could it not retain an easement; and WHEREAS, it now appears to the City Council of the City of Everett that the said street resolved to be vacated should be vacated pursuant to the terms and conditions of this ordinance; NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the following described right-of-way: That portion of Spokane Drive lying Southerly of the Westerly extension of the South line of the North 50.00 feet of the Southwest quarter of the Southwest quarter of the Southwest quarter of Section 8, Township 28 North, Range 5 East, W.M., and Northerly of a straight line extending from the most Southerly corner of Lot 14, plat of Beverly Park, according to the plat thereof recorded in Volume 8 of Plats, page 24, records of Snohomish County, Washington, to the following described point "X": Commencing at the Southwest corner of said Section 8; thence Northerly along the West line of said Section for 675.2 feet to the Northwest corner of the Southwest quarter of the Southwest quarter of the Southwest quarter of said Section; thence Easterly along the North line of said subdivision for a distance of 151.86 feet, more or less, to the West line of Broadway (State Road Number 1 - Pacific Highway) thence Southerly along said West line of Broadway (State Road Number 1) for a distance of 182.65 feet; thence along a curove to the right, having a radius of 66.00 feet, consuming a central angle of 91 36'12" for an arc distance of 105.52 feet to the intersection of the West line of said Section 8, said point of intersection being the above referred to point "X"; TOGETHER WITH that portion of said Southwest quarter of the Southwest quarter of the Southwest quarter of Section 8 lying Southerly of the South line of the North 50.00 feet thereof and Northerly and Westerly of the following described line: Commencing at the Northwest corner of said Southwest quarter of the Southwest quarter of the Southwest quarter; thence Easterly along the North line of said subdivision for 151.86 feet, more or less, to the West line of Broadway
