. � • <br /> ORDINANCE NO. /00e -el <br /> 1 <br /> AN ORDINANCE amending the Zoning <br /> Map of the City of Everett as provided <br /> by Everett Municipal Code, <br /> Title 19, Ord. No. 3572 as amended. <br /> Rezone #5-81 <br /> Bolser Tire <br /> 5425, 5501, 5511 Fleming <br /> WHEREAS, on November 19, 1981, the City of Everett Land Use <br /> Hearing Examiner held a public hearing regarding the rezone of the <br /> hereinafter described property from R-2, Single Family High Density <br /> Residential to B-2 Community Business with contract, and <br /> WHEREAS, the City Council of Everett, on January 25, 1984, <br /> determined that said property should be rezoned and zoned B-2, Community <br /> Business with contract. <br /> NOW, THEREFORE, the City of Everett does ordain: <br /> Section 1: That the City Council of Everett does hereby find <br /> that the zoning change hereinafter set forth is in <br /> the best interest of the City of Everett and meets <br /> the purpose of the Comprehensive Plan. <br /> Section 2: That the proposed zoning change is based on the <br /> property owner of Lots 10 and 11, Block 3, Beverly <br /> Hills Div. 4, meeting the conditions stated in the <br /> attached Concomitant Agreement to the rezone. <br /> Section 3: That the Zoning Map of the City of Everett, as <br /> established by Everett Municipal Code, Title 19 (Ord. <br /> No. 3572 Sec. 4, as amended) is hereby amended from <br /> R-2, Single Family High Density Residential to B-2 <br /> Community Business, subject to the attached <br /> Concomitant Agreement on the following described <br /> parcel: <br /> Lots 9, 10, and 11 , Block 3, <br /> Beverly Hills Div. 4, according to <br /> the Plat thereof recorded in Vol. <br /> 10 of Plats, P. 97, records of <br /> Snohomish County (see attached map) . <br /> Section 4: That the official map in the Planning Department of <br /> the City of Everett shall upon the effective date of <br /> this Ordinance, and the recording of the executed <br /> Concomitant Agreement described in Section 5, be <br /> amended as hereinabove provided, and henceforth said <br /> property shall be used in accordance with the zone <br /> in which the same is now established, as provided by <br /> Everett Municipal Code, Title 19 (Ord. #3572 as <br /> amended) and in accordance with development <br /> requirements stated in the attached concomitant <br /> agreement. <br /> Section 5: That the rezone of the herein described property is <br /> subject to and conditioned upon the terms, <br /> provisions and conditions of the Concomitant <br /> Agreement which is attached hereto and incorporated <br /> herein by reference. <br />
