• <br /> 1 is hereby amended to read hereafter as follows: <br /> 2 <br /> The Law Department shall promptly examine all claims for damages or <br /> 3 injuries against the City submitted to him by the Clerk of the City of <br /> Everett. The Law Department shall be and hereby is authorized to <br /> 4 conduct such investigation into the facts, circumstances and law relative <br /> to any claim for damages or injuries against the City as he, in the <br /> 5 exercise of his discretion, may deem necessary. Such investigations may <br /> be conducted by the Risk Manager or claims investigators under the City <br /> 6 Attorney's directions. <br /> 7 <br /> Section 4: Section 7 of Ordinance No. 288-74 (EMC 3.16.070) which reads as <br /> 8 <br /> follows: <br /> 9 <br /> 10 Claims for damages or injuries shall be processed in the following manner: <br /> 11 (a) Claims for damages or injuries up to $1,000.00 shall be allowed, <br /> disallowed or otherwise settled by a claims committee consisting <br /> 12 of a member of the City Council, the City Attorney, the Risk <br /> Manager and the department head from the City department from <br /> 13 which the claim arises. The claims committee in lieu of allowing <br /> or disallowing such claims may in its discretion refer any such <br /> 14 claim to the City Council. <br /> 15 (b) All claims exceeding $1,000.00 which have been reviewed and <br /> approved for payment by the City Attorney shall be submitted to <br /> 16 the City Council for their approval, disapproval or settlement. The <br /> City Attorney may in his discretion refer any claim exceeding <br /> 17 $1,000.00 to the City Council. <br /> 18 (c) All disapproval of claims either by the claims committee or the <br /> City Attorney's Office may be appealed to the City Council, and <br /> 19 the Council in its discretion may review such claims. The decision <br /> of the City Council shall be final. <br /> 20 <br /> 21 is hereby amended to read hereafter as follows: <br /> 22 <br /> The Law Department shall process claims for damages or injuries in the <br /> 23 following manner: <br /> 24 (a) The Risk Manager shall be authorized to allow, disallow or settle <br /> all claims for damages up to $1,000. <br /> 25 <br /> (b) The City Attorney with concurrence of the Risk Manager shall be <br /> 26 authorized to allow, disallow or settle all claims up to $10,000. <br /> 27 (c) Claims for damages or injuries between $10,000 and $20,000 shall <br /> be allowed, disallowed or otherwise settled by a claims committee <br /> 28 consisting of a member of the City Council, the City Attorney, the <br /> Risk Manager, and the department head from the City department <br /> 29 from which the claim arises. <br /> 30 (d) All claims exceeding $20,000 which have been reviewed by the City <br /> Attorney shall be submitted to the City Council for their approval, <br /> 31 disapproval or settlement. <br /> 32 -2- <br />
